Covid-19, Occupational Diseases and Employer´s Responsibility: Management of Conflicts in the Labor Sphere

Resumo: The theme of the employer´s civil responsibility is discussed when employees are infected with Covid-19, especially with regard to obligations due to labor insurance. Current qualitative and theoretical research, based on doctrine, law and jurisprudence, deals with the importance of complying to labor insurance during the pandemic, investigated as a prevention method for the solution of labor conflicts. Research has identified the effects of acknowledging Covid-19 as an occupational disease. Results show that the acknowledgement of Covid-19 as an occupational disease provides greater juridical safety to employees, or rather, the applications of prevention methods may hinder the judicialization of labor suits e avoid economic liabilities to the employer.

En el presente artículo se tiene como objetivo abordar el tema de la responsabilidad civil del empleador en los casos en que el trabajador sufre daño debido a contaminación por la Covid-19, en especial, en lo que refiere a las obligaciones derivados de seguridad del trabajo. Se explaya, aún, en el presente estudio sobre la importancia del cumplimento de las obligaciones referentes a la seguridad del trabajo en época de pandemia como método preventivo de solución de conflictos laborales, por método deductivo y por intermedio de investigación cualitativa y teórica, basándose en la doctrina, ley y jurisprudencia. En la presente investigación se identificó los reflejos del reconocimiento de la Covid-19 como enfermedad ocupacional. Como resultado de la investigación, tras análisis de las fuentes mencionadas, fue posible responder que el reconocimiento de la Covid-19 como enfermedad ocupacional proporciona más seguridad jurídica al empleado, y restó evidente que la aplicación de métodos preventivos puede impedir la judicialización de acciones laborales y evitar perjuicios económicos al empleador. O presente artigo tem como objetivo abordar o tema da responsabilidade civil do empregador nos casos em que o trabalhador sofre dano em razão da contaminação pela Covid-19, em especial, no que tange às obrigações decorrentes de segurança do trabalho. Discorre-se, ainda, no presente trabalho sobre a importância do cumprimento das obrigações referentes à segurança do trabalho em época de pandemia como método preventivo de solução de conflitos trabalhistas, por método dedutivo e por meio de pesquisa qualitativa e teórica, baseando-se na doutrina, lei e jurisprudência. A presente pesquisa identificou os reflexos do reconhecimento da Covid-19 como doença ocupacional. Como resultado da pesquisa, após análise das fontes mencionadas, foi possível responder que o reconhecimento da Covid-19 como doença ocupacional proporciona maior segurança jurídica ao empregado, e restou evidente que a aplicação de métodos preventivos pode impedir a judicialização de ações trabalhistas e evitar prejuízos econômicos ao empregador.
