Resumo: Current essay shows the manner the concept of sustainability developed during the last decade. In fact, the term may be applied to any firm or activity. Sustainability may deal with environmental sustainability and with several activities linked to information society. Different forms of sustainable production and the valorization of sustainable firms in the post-modern period are shown. Since a juridical nature may be provided to a widened concept of sustainability, the essay develops a model of sustainable behavior based on the application of basic constitutional principles within entrepreneur activity. The firms’ social function as an implicit constitutional principle is enhanced. Products and facts are forwarded as examples of non-sustainable activities and a juridical theory is formed for non-sustainability and its effects.

Trabalha em duas vertentes, o da sustentabilidade ambiental e de diversas atividades ligadas à sociedade da informação. Demonstra as diferentes formas de produção sustentável e a valoração das empresas sustentáveis na pós-modernidade. Tentando traçar uma natureza jurídica para o conceito ampliado de sustentabilidade, o presente trabalho desenvolve um modelo de conduta sustentável que se baseia na aplicação dos princípios fundamentais constitucionais na atividade empresarial. Explora principalmente a função social das empresas como princípio implícito constitucional.
