Rights of the Person: Terminologies, Structure and Acceptance

Resumo: | The rights of the human person have already been incorporated in court practice and are disseminated within academic investigations. Both employ a synthetic formula that rights of the person are the protection of the person based on the dignity of the human person, with terminologies, structure and reception. Which is the theoretical field of human rights? The hypothesis is that the theoretical field lies in the possibility for the development of human rights within the Brazilian scenario. Current research aims at investigating a landscape with the distinctions of terms adjacent to the right of the person and the theoretical topography in which they are found to qualify the debate. Two specific aims are followed, according to the paper´s structure: a) to distinguish the semantics of the main terminologies linked to the expression right of the person and b) to verify the reception of the rights of the person in Brazilian juridical ordering. The hypothetical and deductive method is employed to delineate terminologies and adjacent theories for the formation of a theoretical framework in which the rights of the person are inserted. Results show the need to recover or reactivate some theoretical debates that affect our perceptions and practices of the rights of the person for the person´s integral defense. |

Los derechos de la personalidad ya se incorporaron en las prácticas forenses y se encuentran cada vez más diseminados en el debate académico. Ambas esferas costumbran utilizar una fórmula sintética de que los derechos de la personalidad son protecciones de la persona fundamentada por la dignidad de la persona humana, dejando un campo teórico presupuesto de terminologías, estructura y recepción. De esa manera, la pregunta de investigación que orienta este estudio es: ¿cuál es el campo teórico presupuesto de los derechos de la personalidad? La hipótesis que se estudia es que el rescate del campo teórico presupuesto es condición de posibilidad para el desarrollo de los derechos de la personalidad en el escenario nacional. El objetivo general de la investigación es analizar un panorama con las distinciones de términos adyacentes a los derechos de la personalidad y la topografía teórica en que se encuentran, con la finalidad calificar el debate del instituto. De esa forma, se establecen dos objetivos específicos, que se coadunan con la estructura del artículo en dos secciones: a) distinguir la semántica de las principales terminologías utilizadas vinculadas a la expresión derechos de la personalidad; y b) verificar la recepción de los derechos de la personalidad en el ordenamiento jurídico brasileño. El método utilizado es el hipotético-deductivo, delineando las terminologías y teorías adyacentes para formación de un cuadro teórico en el cual se insertan los derechos de la personalidad. Al final de la investigación, los resultados apuntan la necesidad de rescatarse o reactivar algunos debates teóricos que influencian nuestras percepciones y prácticas de los derechos de la personalidad para integral defensa de la persona.Os direitos da personalidade já foram incorporados nas práticas forenses e encontram-se cada vez mais disseminados no debate acadêmico. Ambas as esferas costumam utilizar uma fórmula sintética de que os direitos da personalidade são proteções da pessoa fundamentada pela dignidade da pessoa humana, deixando um campo teórico pressuposto de terminologias, estrutura e recepção. Dessa maneira, a pergunta de pesquisa que orienta esta investigação é: qual o campo teórico pressuposto dos direitos da personalidade? A hipótese que se trabalha é que o resgate do campo teórico pressuposto é condição de possibilidade para o desenvolvimento dos direitos da personalidade no cenário nacional. O objetivo geral da pesquisa é analisar um panorama com as distinções de termos adjacentes aos direitos da personalidade e a topografia teórica em que se encontram, com a finalidade de qualificar o debate do instituto. Dessa forma, estabelecem-se dois objetivos específicos, que se coadunam com a estrutura do artigo em duas seções: a) distinguir a semântica das principais terminologias utilizadas vinculadas à expressão direitos da personalidade; e b) verificar a recepção dos direitos da personalidade no ordenamento jurídico brasileiro.
