The Inviolability of the Human Person and the General Rights of the Personality

Resumo: | Current descriptive and deductive research based on bibliographical, jurisprudential and legislative investigation, comprises a brief study on the general right of the person including the existing relationships between this right and the person´s special rights. The most relevant themes analyzed include the development of the general rights of the person in German-speaking countries and the posterior admission in other civil law countries. Analysis makes clear the idea of existing cooperation between general rights of the person and the special rights of the personality as their development. The existence within the Brazilian juridical order of a plurality of personality rights or the adoption of the personality´s general law is debated. Current analysis presents the bases for the protection of the rights of the personality through the personality´s general law and provides the reader an overview of the theme with special emphasis on Brazilian reality. |

En el presente artículo se realiza un breve estudio sobre el derecho general de la personalidad, abarcando las relaciones existentes entre ese derecho y los derechos especiales de la personalidad. Se trata de investigación que utiliza metodología descriptiva y deductiva, basada fundamentalmente en la investigación bibliográfica, jurisprudencial y legislativa. Los temas más relevantes de la materia son analizados, como el desarrollo del derecho general de la personalidad en os países de lengua alemana y su posterior admisión en otros países de la civil law. El estudio deja claro al lector la idea de cooperación existente entre el derecho general de la personalidad y los derechos especiales de la personalidad, estos considerados como desdoblamientos de aquel. Merece aún atención el debate sobre la existencia, en el ordenamiento jurídico brasileño, de una pluralidad de derechos de la personalidad o la adopción del derecho general de la personalidad. Por ser así, el estudio tiene como objetivo presentar los fundamentos de la protección de los derechos de la personalidad por el derecho general de la personalidad, da al lector una mirada panorámica del tema, con enfoque en la realidad brasileña. O presente artigo realiza um breve estudo sobre o direito geral da personalidade, abrangendo as relações existentes entre esse direito e os direitos especiais da personalidade. Trata-se de pesquisa que utiliza metodologia descritiva e dedutiva, baseada fundamentalmente na investigação bibliográfica, jurisprudencial e legislativa. Os temas mais relevantes da matéria são analisados, como o desenvolvimento do direito geral da personalidade nos países de língua alemã e a sua posterior admissão em outros países da civil law. O estudo deixa claro ao leitor a ideia de cooperação existente entre o direito geral da personalidade e os direitos especiais da personalidade, estes considerados como desdobramentos daquele. Merece ainda destaque o debate sobre a existência, no ordenamento jurídico brasileiro, de uma pluralidade de direitos da personalidade ou a adoção do direito geral da personalidade.
