The rights of the person are discussed to analyze their frontier with regard to fundamental human rights. It should be emphasized that the discipline on the person cannot be framed within the compartments of 18th century codifications, especially with regard to self-determination. In the wake of the construction of subjectivity, the subject is protected by the general tutelage clause in the civil order derived from constitutional principles and human rights. There is therefore a deep relationship between the right of the person, fundamental rights and human rights. They all show the person’s common tutelage spaces without the autonomy of each category.
