Resumo: In Law, the orientating principle of juridical order is the dignity of the human person. The Brazilian constitution guarantees dignity as a basic factor of the Republic which, in turn, established limits to the constituting executive and legislative powers and to society’s attitudes. The dignity of the human person was effectively placed in the Brazilian constitution in the wake of the terrible atrocities by previous administrations. The dignity of the human person has currently the fundamental role to warrant the law-abiding democratic state. Since it is the main protection of fundamental rights, the dignity of the human person defends all forms of human life. So that human life could be protected in its very essence and in its physical, intellectual and psychological development, the right to human dignity should be applied since its efficacy is the Constitution’s basic of life’s dignity.

La Constitución Federal al garantizar la dignidad como fundamento de la republica estableció límites a los poderes constituyentes, ejecutivo y legislativo, bien como a las actitudes de la sociedad. Solo fue posible positivar la dignidad de la persona humana en la constitución brasileña debido a las grandes atrocidades cometidas por los gobiernos anteriores. La dignidad de la persona humana hoy ocupa papel fundamental para la garantía del Estado democrático de Derecho. Por ser la principal protección de los derechos fundamentales cabe la dignidad de la persona humana defender toda forma de vida humana existente. Para que la vida humana sea protegida en su esencia, en su desarrollo físico, intelectual, y psicológico, el Derecho a la dignidad humana precisa ser aplicado, su eficacia es lo que nortea la garantía Constitucional de vida digna.O Direito a dignidade da pessoa humana é o principio norteador do ordenamento jurídico. A Constituição Federal ao garantir a dignidade como fundamento da republica estabeleceu limites aos poderes constituinte, executivo e legislativo, bem como as atitudes da sociedade. Só foi possível positivar a dignidade da pessoa humana na constituição brasileira devido as grandes atrocidades cometidas pelos governos anteriores. A dignidade da pessoa humana hoje ocupa papel fundamental para a garantia do Estado democrático de Direito. Por ser a principal proteção dos direitos fundamentais, cabe a dignidade da pessoa humana defender toda forma de vida humana existente.
