Resumo: This article, based on bibliographical reviews, aims to analyze the development of a possible death policy adopted by the State in the face of the prison population and its most varied actors in the pandemic scenario. Therefore, we seek to understand the Brazilian prison structure and the development of a technique for exercising power called by Achille Mbembe as necropolitics. Since then, we seek to collect data on the impact of covid-19 in prison in order to ascertain the real situation of the prison population in times of pandemic and the need to find emergency solutions to protect the lives of the great masses prison that is sensitively vulnerable to contagion by this new disease. In this way, after verifying the reality supported by the prison system with the advance of covid-19 in prison, the article seeks to analyze the urgency of a humanitarian penal legal system, which will reform the relationship between the human person and prison.

Para ello, se hace necesario comprender la estructura carcelaria brasileña y el desarrollo de una técnica de ejercicio del poder denominada por Achille Mbembe como necropolítica. A partir de ahí, se pretende recoger datos sobre el impacto del covid-19 en la cárcel para conocer la situación real de la población penitenciaria en tiempos de pandemia y la necesidad de encontrar soluciones de emergencia para salvaguardar la vida de la gran masa de presos que son sensiblemente vulnerables a la infección por esta nueva enfermedad. En estos moldes, habiendo comprobado la realidad soportada por el sistema penitenciario con el avance del covid-19 en prisión, el artículo busca analizar la urgencia de un sistema jurídico penal de carácter humanitario, que venga a reformar la relación entre la persona humana y la prisión.O presente artigo, partindo de revisões bibliográficas, tem como objetivo analisar o desenvolvimento de uma possível política de morte adotada pelo Estado em face da população carcerária e de seus mais variados atores no cenário pandêmico. Para tanto, procura-se compreender a estrutura prisional brasileira e o desenvolvimento de uma técnica de exercício do poder denominada por Achille Mbembe como necropolítica. Busca-se coletar dados sobre o impacto da covid-19 no cárcere a fim de se averiguar a real situação da população prisional em tempos de pandemia e a necessidade de se encontrar saídas emergenciais para se resguardar a vida da grande massa carcerária que se encontra sensivelmente vulnerável ao contágio por esta nova enfermidade.
