Autonomy of the Elderly and the Interamerican Convention on the Protection of Elderly People´s Rights

Resumo: In the wake of the rapid aging of the population, one should urgently reflect on its implications, among which may be mentioned the existence of aging and the numberless situations of violation of rights of the elderly who need protection from the state, family and society, without discarding existential autonomy. Assuming the autonomy of the elderly as one of the general principles, the Interamerican Convention on the protection of rights of the elderly may contribute for a greater agency of this group through new rights and the reinforcements of already existing ones. The hypothetical and deductive method will demonstrate the importance of its ratification in Brazil with an approach on situations with regard to the violation to self-determination. Due to its great capacity in forwarding rights and cultural changes on the autonomy of aging, the Interamerican Convention is a normative landmark for Human Rights on the continent.

Delante el acelerado envejecimiento de la populación es primordial reflexionar acerca de sus implicaciones. Entre ellas están: la existencia del ageísmo y de innúmeras situaciones de violaciones de derechos adecuado a la populación mayor, que exigen protección del Estado, de la familia y de la sociedad, sin dejar de cuidar también por el respeto a la autonomía, sobre todo la existencial, excepto efectiva incapacidad. En ese contexto, adoptando la autonomía de la persona mayor como uno de los principios generales, la Convención Interamericana sobre la protección de los derechos de los ancianos puede contribuir para más protagonismo de ese grupo, sea por los nuevos derechos previstos, sea por el refuerzo a la implementación de los ya existentes. Por intermedio del método hipotético-deductivo, se busca demostrar la importancia de la ratificación de esa Convención por Brasil, se aborda aún situaciones de violación a la autodeterminación. Por el gran potencial al avance de derechos y de cambios culturales sobre la autonomía en el envejecer, la mencionada Convención configura verdadero marco normativo del Sistema Interamericano de Derechos Humanos. Ante o acelerado envelhecimento populacional, é indispensável refletir acerca de suas implicações. Entre elas estão: a existência do ageísmo e de inúmeras situações de violações de direitos em face da população idosa, que exigem proteção do Estado, da família e da sociedade, sem deixar de zelar também pelo respeito à autonomia, sobretudo a existencial, salvo efetiva incapacidade. Nesse contexto, adotando a autonomia da pessoa idosa como um dos princípios gerais, a Convenção Interamericana sobre a proteção dos direitos dos idosos pode contribuir para maior protagonismo desse grupo, seja pelos novos direitos previstos, seja pelo reforço à implementação dos já existentes. Por meio do método hipotético-dedutivo, busca-se demonstrar a importância da ratificação dessa Convenção pelo Brasil, abordando-se ainda situações de violação à autodeterminação. Pelo grande potencial ao avanço de direitos e de mudanças culturais sobre a autonomia no envelhecer, a mencionada Convenção configura verdadeiro marco normativo do Sistema Interamericano de Direitos Humanos.
