RIGHTS OF CONDEMNED PRISONERS WITH REGARD TO WORK AND EDUCATION IN THE STATE OF PARÁ, BRAZIL: A CASE STUDY IN THE STATE AND METROPOLITAN PRISON (PEM II)

Resumo: Current essay discusses whether the rights of prisoners with regard to work and education are complied with in the state of Pará, Brazil, specifically in the state and metropolitan prison (PEM II) so that human dignity is maintained and incentives to re-socialization are undertaken. The dialectic approach is undertaken, coupled to review of the literature, documental research, a case study, research-activity, data analyses by qualitative and quantitative research. Results showed that the prison term, plus education and work, is not being developed according to the Law of Penal Execution. Prisons had a harder problem to cope with: or rather over-population, mostly occupied by provisional prisoners, with an improvement in educational and labor assistance conceded to the convicts.

Prisons had a harder problem to cope with: or rather over-population, mostly occupied by provisional prisoners, with an improvement in educational and labor assistance conceded to the convicts.Ese trabajo objetiva identificar si los derechos del apenado, en relación al trabajo y educación, se encuentran protegidos en el estado del Pará, en particular en el presidio Estadual Metropolitano II, observando si se mantiene la dignidad de la persona humana y el posible incentivo a su resocialización. El método de abordaje utilizado fue el dialéctico, con revisión de la literatura, como método de procedimiento la investigación documental, el estudio de caso y la investigación-acción, el análisis de los datos fue hecho por medio de investigación cuantitativa y cualitativa. Como resultado, se observó que el cumplimiento de la pena, en lo que se refiere a la educación y el trabajo, no es desarrollado en conformidad con lo preceptuado en la Ley de Ejecución Penal. Se concluye que los establecimientos penales poseen como problema más grave a ser enfrentado, la ocupación que excede las plazas existentes, en su gran mayoría constituida por encarcelados provisorios, siendo requerido el mejoramiento de la asistencia educativa y del trabajo ofrecido al apenado.O presente trabalho tem como objetivo identificar se os direitos do apenado, em relação ao trabalho e à educação, encontram-se resguardados no Estado do Pará, em particular no Presídio Estadual Metropolitano II, com vista a manter a dignidade da pessoa humana e o possível incentivo à sua ressocialização. O método de abordagem utilizado foi o dialético, com a revisão da literatura, e como método de procedimento a pesquisa documental, o estudo de caso e a pesquisa-ação, com a análise dos dados por meio da pesquisa quantitativa e qualitativa. Como resultado, observou-se que o cumprimento da pena, no que tange à educação e ao trabalho, não é desenvolvido de acordo com o preceituado na Lei de Execução Penal.
