Personality Rights as a Limit For The Information And Media Rights

Resumo: The Federal Constitution embodied in its text, several fundamental rights, among them the information and media rights and the personality rights. And, despite all these rights that are fundamental and essential to the healthy quality of life, they are rights that should be limited by the state for the good of society. To that end, the personality rights can be used as a limit to the information and media rights. Meanwhile, to understand the size and the need for significant restriction of these rights, it was addressed issues relating to them. As the social responsibility of the mass media, the involvement of citizenship and the information and media rights in itself are considered. The aim of this study is to discussion about the vital rights that have been marginalized by the community. As needed, both to society as to the legal sphere, the discovery of these effects and consequences that such rights and freedoms may cause in the current generation, and that it is essential to have limits, without being establishment censorship. Right now, information is recognized as the new trade currency and the power for that currency, has been established.

Y, pese al hecho de que todos son considerados derechos fundamentales, y esenciales a la sana calidad de vida son derechos que deben ser limitados por el Estado para el bien de la sociedad. Para tal, los derechos de la personalidad pueden y son utilizados como limitadores de los derechos de información y de comunicación social. Sin embargo, para comprenderse la dimensión y la necesidad de importante restricción a estos derechos, se ha tratado de diversos temas relativos a ellos. Como la responsabilidad social de los medios de comunicación de masa, el envolvimiento de la ciudadanía y los derechos de información y de comunicación social en si considerados. Se objetiva con este estudio la discusión sobre derechos tan imprescindibles que han sido marginados por la comunidad. Siendo necesario, tanto para la sociedad como para la esfera jurídica, el descubrimiento de los efectos e impactos que tales derechos y libertades pueden causar en la generación actual, y la imprescindibilidad de que se constituyen los límites, sin que sea establecida la censura. Pues actualmente, la información es vista como la nueva moneda de comercio y el poder por tal moneda, se ha establecido.A Constituição Federal consagrou em seu texto, vários direitos fundamentais, dentre eles, os direitos de informação e de comunicação social e os direitos da personalidade. E, apesar de todos estes serem direitos fundamentais, e essenciais à sadia qualidade de vida são direitos que devem ser limitados pelo Estado para o bem da sociedade. Para tanto, os direitos da personalidade podem e são usados como limitadores aos direitos de informação e de comunicação social. Entretanto, para se entender a dimensão e a necessidade de importante restrição a esses direitos, abordou-se temas relativos a eles. Como a responsabilidade social dos meios de comunicação de massa, o envolvimento da cidadania e os direitos de informação e de comunicação social em si considerados. Objetiva-se com o presente estudo a discussão acerca de direitos tão imprescindíveis que têm sido marginalizados pela comunidade. Sendo necessária, tanto para a sociedade quanto para a esfera jurídica, a descoberta dos efeitos e impactos que tais direitos e liberdades podem causar na geração atual, e a imprescindibilidade de que se constituem os limites, sem que seja estabelecida a censura.
