Judiciary and Involuntary Commitment: Mapping the Decisions of the Court of Justice of the State of Rio de Janeiro

Resumo: | Law No. 10,216/2001 emerged within a process of reorientation of the Brazilian care model in mental health. Among the various possible debates based on the aforementioned legislation, the present study chooses to analyze the principle of involuntary commitment, which is that determined by the courts. In this sense, the article presents the results of a research that aimed to map the judicial decisions issued in the Court of Justice of the State of Rio de Janeiro, between 2001 and 2016, in cases of involuntary commitment. The analysis verified the number of involuntary commitment proceedings each year, the profile of the people subject to an internment proceeding and the profile of those requesting commitment. It was concluded that, in general, requests for involuntary commitment are made by the relatives of the patient, and that the patient, in most cases, is classified as a drug user. |

La Ley n.º 10.216/2001 surgió dentro de un proceso de reorientación del modelo de atención brasileño en salud mental. Entre los diversos debates posibles a partir de la referida legislación, se opta, en este estudio, por el análisis del instituto del ingreso involuntario, que es el que determina la Justicia. En este sentido, el artículo presenta los resultados de una investigación que tuvo como objetivo mapear las decisiones judiciales pronunciadas en la Corte de Justicia del Estado de Río de Janeiro, entre 2001 y 2016, en procesos de ingreso involuntario. El análisis verificó el número de ingresos involuntarios al año, el perfil de las personas sujetas a un proceso de ingreso y el perfil de los solicitantes de ingreso. Se concluyó que, en general, las solicitudes de ingreso involuntario son solicitadas por los propios familiares del ingresado, y que éste, en la mayoría de los casos, se clasifica en los procesos como consumidor de drogas. A Lei nº 10.216/2001 surgiu dentro de um processo de reorientação do modelo assistencial brasileiro em saúde mental. Dentre os diversos debates possíveis a partir da referida legislação, opta-se, no presente estudo, pela análise do instituto da internação compulsória, que é aquela determinada pela Justiça. Nesse sentido, o artigo apresenta os resultados de uma pesquisa que teve como objetivo fazer um mapeamento das decisões judiciais proferidas no Tribunal de Justiça do Estado do Rio de Janeiro, entre 2001 e 2016, em processos de internação compulsória. A análise verificou a quantidade de processos de internação compulsória em cada ano, o perfil das pessoas passíveis de um processo de internação e o perfil de quem solicita a internação. Concluiu-se que, em geral, os pedidos de internação compulsória são solicitados pelos próprios familiares do internado, e que este, na maioria das vezes, é classificado nos processos como usuário de drogas.
