Resumo: The juridical effects of invalid and void testaments and their consequences in Brazilian succession law are discussed. The theme is important owing to the great number of juridical processes extant which problematize the validity of the last will. Since the testament’s efficaciousness is differed to a period after the testator’s death and the latter cannot revise the document, it is assumed that the last will should be respected in all possible circumstances.

La importancia del tema es confirmada por la cantidad de procesos judiciales en curso, cuestionando la validez del acto de última voluntad. Como la ineficacia del testamento es diferida tras l muerte del testador y este no podrá realizar una vez más el acto, se entiende que su última voluntad debe de ser preservada, siempre que sea posible.Este artigo tem o escopo de discutir os efeitos jurídicos dos testamentos inválidos e ineficazes, bem como sua implicação no direito sucessório brasileiro. A importância do tema é confirmada pelos inúmeros processos judiciais em andamento, questionando a validade do ato de última vontade.
