Resumo: The family as a social institution has undergone many changes over the centuries. Of today, without biology of family relationships, kinship is more predominant factor for the characterization of the child, but the affection, hence the emerging socio-affective affiliation. Replaced by the concept of socio-affective affiliation, with the distinction between its entirety ended with its proceedings to the constitution. The socio-affective affiliation has great social relevance, because it is possible, by evidence of links from affinity and love, be given to an individual all the rights arising from membership.

Actualmente, con el proceso de desbiologización de las relaciones familiares, la consanguinidad no es más un factor predominante para la caracterización del estado de hijo, sino el afecto, de ahí que surge la filiación socioafectiva. Enseguida de la presentación del concepto de filiación socioafectiva, con la distinción de sus rasgos más significativos, se presenta el procedimiento judicial para su constitución. La filiación socioafectiva posee gran relevancia social, pues posibilita que, por medio de la comprobación de vinculos que recurren de afinidad y amor, se conceda a un individuo todos los derechos que recurren de la filiación.A família, enquanto organismo social, passou por inúmeras transformações ao longo dos séculos. Hodiernamente, com a desbiologização das relações familiares, a consangüinidade não é mais fator predominante para a caracterização do estado de filho, e sim o afeto, daí surgindo a filiação socioafetiva. Passa-se pela conceituação de filiação socioafetiva, com a distinção entre seus elementos marcantes, terminando com seu procedimento judicial para constituição.
