Family Law in the Light of Zygmunt Bauman’s Liquid Modernity: Affection, Depatrimonialization, and Parental Dynamicity

Resumo: This paper reflects on the legal characteristics of Brazilian Family Law based on the interdisciplinary relationship between sociology and law. The issue is: how could the liquid modernity theory contribute to guarantee an adequate treatment of these contemporary realities in the legal sphere? The purpose of this study is to investigate the characteristics of Family Law based on Zygmunt Bauman’s theory of liquid modernity. The method applied was the hypothetical-deductive method, using the literature review technique. In the final considerations, it is highlighted that affection, depatrimonialization, and parental dynamicity, current characteristics of Brazilian Family Law, are supported by concepts extracted from the theory of liquid modernity, thus allowing an understanding of the contemporary family in order to promote a legal protection free from prejudice.

Este texto reflexiona sobre las características legales del Derecho de Familia brasileño desde la interdisciplinariedad entre la sociología y el derecho. La cuestión es: ¿de qué manera podría la teoría de la modernidad líquida contribuir a garantizar un tratamiento adecuado de estas realidades contemporáneas en el ámbito jurídico? El objetivo de este estudio consiste en averiguar las características del Derecho de Familia teniendo como parámetro la teoría de la modernidad líquida de Zygmunt Bauman. El método aplicado fue el hipotético-deductivo, utilizando la técnica de revisión bibliográfica. En las consideraciones finales, se resalta que la afectividad, la despatrimonialización y la dinamicidad parental, características actuales del Derecho de Familia brasileño, se sustentan en conceptos extraídos de la teoría de la modernidad líquida, permitiendo así la comprensión de la familia contemporánea con miras a promover una protección jurídica libre de prejuicios. O presente texto traz uma reflexão em relação às características jurídicas do Direito de Família brasileiro a partir da interdisciplinaridade entre a sociologia e o direito. A problemática é: de que maneira a teoria da modernidade líquida poderia contribuir para garantir uma tratativa adequada dessas realidades contemporâneas no âmbito jurídico? O objetivo do presente estudo consiste em perquirir sobre as características do Direito de Família tendo como parâmetro a teoria da modernidade líquida de Zygmunt Bauman. O método aplicado foi o hipotético-dedutivo, utilizando a técnica de revisão bibliográfica. Nas considerações finais, destaca-se que a afetividade, a despatrimonialização e a dinamicidade parental, características atuais do Direito de Família brasileiro, têm respaldo nos conceitos extraídos da teoria da modernidade líquida, permitindo, assim, a compreensão da família contemporânea com vistas a promover uma tutela jurídica livre de preconceitos.
