Sexual Harassment in the Labor Relationship

Resumo: | It is well-known that the economical crisis introduced a high number of women in the labor market, promoting like this, a larger relationship between men and women. This familiarity has been promoting, mainly, the sexual harassment that it is exercising serious influences on the levels of work quality and company competitiveness, and consequently, being reflected in the workers' life conditions and in the atmosphere that they develop their activities. In the sense of deepening knowledge concerning this subject, we search for legislation, jurisprudence and doctrine, necessary elements to draw a general panorama on the sexual harassment in the relationship labor theme. This study has as objective to know and to analyze the labor relationships that are established due to the somebody embarrassment with the intention of obtaining advantages and sexual fostering, prevailing the agent of his/her position or exercised function. Highlighting, that this attitude violates the worker's intimacy right, as well as, the human dignity, constitutionally insured warranties, the employer or coworker is not able to violate them. |

Esa convivencia ha promovido, principalmente, el asedio sexual, que viene ejerciendo serias influencias en el nivel de calidad del trabajo y de la competitividad de la empresa y, en decurso de eso, reflejándose en las condiciones de vida de los trabajadores y en el entorno en que se desarrollan esas actividades. Así, para profundar el conocimiento sobre esa cuestión, busco la legislación, jurisprudencia y doctrina, elementos necesarios para hacer un recorrido general sobre la temática del asedio sexual en la relación laboral. Ese estudio tiene como objetivo conocer y analizar las relaciones de trabajo que se establecen debido al constreñimiento de alguien con el intuito de obtener ventajas y beneficio sexual, haciendo prevalecer el agente de su rango o función ejercida, destacando que esa actitud viola el derecho de intimidad del trabajador, así como la dignidad humana, garantías esas constitucionalmente aseguradas, no pudiendo el empleador o colega de trabajo violarlas.É notório que a crise econômica introduziu um elevado número de mulheres no mercado de trabalho, promovendo assim um maior relacionamento entre homens e mulheres nesse ambiente. Este convívio tem promovido, principalmente, o assédio sexual, que vem exercendo sérias influências sobre os níveis de qualidade do trabalho e de competitividade da empresa e, consequentemente, refletindo-se nas condições de vida dos trabalhadores e no ambiente em que se desenvolvem suas atividades. No sentido de aprofundar o conhecimento acerca da questão, busco a legislação, jurisprudência e doutrina, elementos necessários para traçar um panorama geral sobre a temática do assédio sexual na relação laboral.
