Uma análise urbanística do loteamento e sua regularização

Resumo: This article presents the procedure for the subdivision of lots and their regularization, this subject covers the Right of Property that disciplines the action of each individual to use and enjoy what is his right. Passing through the property right advances to the area of Allotments and in how this right guide the subject. The part of public politics implemented in the light of rural allotments, the incentive offered to small producers and how family agricultural allotments work could not be left out. Recently, Decision Nº 4387707-GC which encompasses the rural module part and rules for the regularization of these allotments. Land regularization will be presented as a complementary subject, which is nothing more than a series of legal, urban, environmental and social actions with the aim of regularizing clandestine occupations. The proposal of the theme is to answer doubts and bring viable solutions within the existing legislation, awakening studies and debates to the area that is complex, but is interesting for economic and social development.

Passando pelo direito da propriedade avança-se para a área de Loteamentos e em como esse direito norteia o assunto. Não poderia ser deixado de fora a questão das políticas públicas implementadas pensando nos loteamentos rurais, o incentivo ofertado para pequenos produtores e como funcionam os loteamentos agrícolas familiares. Recentemente, a Decisão nº 4387707-GC que engloba a parte de módulo rural e regras para a regularização desses loteamentos. Como assunto complementar será apresentada a regularização fundiária, que nada mais é do que uma série de ações de natureza jurídica, urbanística, ambiental e social com o objetivo de regularizar ocupações clandestinas.
