Resumo: This present work, by the documental bibliographic, search to study consequences of parental alienation in a women vision, inside the feminist context, and is demonstrated how malefic is a Law creation whose course about the society patriarchal model. Inside this context, it was approached a brief historic of family construction of family and the evolution of it about the social changes, for later, emphasize the prejudice of the creation of Law nº 12.318/10 and your applicability as it is realized by the National Courts. This research justifies itself, once the applicability out of context, of parental alienation context has been prejudicial for the exercise of women rights and total protection of children.

This research justifies itself, once the applicability out of context, of parental alienation context has been prejudicial for the exercise of women rights and total protection of children.O presente trabalho, por meio da bibliografia documental, buscou estudar as consequências da alienação parental na visão da mulher, dentro do contexto feminista, e demonstrou o quão maléfico é a criação da lei que disciplina acerca do referido tema, pois acaba por fazer uma interpretação errônea do instituto frente ao modelo de sociedade patriarcal. Dentro deste contexto, foi abordado um breve histórico da construção de família e a evolução desta frente às mudanças sociais, para, posteriormente, evidenciar o prejuízo da criação da Lei nº 12.318/10 e sua aplicabilidade da forma como é realizada pelos Tribunais pátrios.
