Gravidez no sistema prisional brasileiro e a violação da dignidade humana da gestante em prisão preventiva

Resumo: The pregnancy in the brazilian prison system and the violation of human dignity of pregnant women in preventive prison are part of the prison scene. The main objective was analyse pregnancy in the brazilian prison system and from this, show the violations of human dignity of pregnant women in preventive prison. Used from the hypothetical deductive and theorical method, this last one passed from books analytics, periodic articles, electronic documents and legislation about this theme. The prison units since their constitution shows poor conditions of infrasctructure, hygiene and health for female inmates, worsening when they are pregnant. With this research, the conclusion was made that the brazilian prison system violates the human dignity of pregnant women in preventive prison. The Federal Court of Justice judged the collective Harbeas Corpus nº 143.641/SP, that predicts the replacement of preventive prison to home prison for pregnant women that are in preventive prison. In this way, one of the solutions to this problem is the replacement of the preventive prison to home prison. The research comes from the study of the brazilian prison system since the Brazil-Colony until today, as well the creation and difficulty current in female prison system, with enphasis in pregnancy of women in preventive prison.

O objetivo central foi analisar a gravidez no sistema prisional brasileiro e a partir desta, demonstrar a violação da dignidade humana da gestante em prisão preventiva. Utilizou-se o método hipotético-dedutivo e teórico, sendo que este último decorrou de análises de livros, artigos de periódicos, documentos eletrônicos e legislações pertinentes acerca do tema. As unidades prisionais desde a sua constituição apresentam condições precárias na infra-estrutura, higiene e saúde, diante do gênero feminino há um agravante, a gravidez no sistema carcerário. Diante da pesquisa chegou à conclusão que a gravidez no sistema prisional brasileiro viola a dignidade humana da gestante em prisão preventiva. O Supremo Tribunal Federal julgou o habeas corpus coletivo nº 143.641/SP, o qual prevê a substituição da prisão preventiva em domiciliar para as gestantes que estão em prisão preventiva. Assim, uma das soluções para tal problemática é a conversão da prisão preventiva em prisão domiciliar.
