This article aims to show how the State, through its role of regulator of society, carries out the application of the penalty of an educational character for society and retribution to individuals for the criminal acts performed. This may be lacking in the provision of a due legal process, disregarding the principles and norms established by the legislator, seeking a dignified service for all. And how the miscarriage of justice in the criminal sphere resulting in the imprisonment of an innocent person can result in irreparable damage to the individual, in addition to corrupting the purpose of the penalty. Judicial error, in great majority, is caused by personal recognition derived from a false memory. For this reason, this article has as its main objective to establish the connectivity of the judicial error and the civil liability of the State for the possibility of indemnification for the damage caused to the individual's life project.
