The USMCA sunset clause

Resumo: The Agreement between the United States of America, the United Mexican States, and Canada (USMCA) includes a sunset clause that states that the agreement shall terminate 16 years after the date of its entry into force, unless each Party expresses its will to continue the agreement for another 16 years. We will apply John H. Jackson’s theory on power oriented and rule oriented diplomacy to analyze that sunset clause. We argue that the sunset clause will offer strong incentives for power oriented diplomacy, and that this will likely affect USMCA dispute settlement, authentic interpretations and efforts to diversify trade flows.
