Resumo: The following article consisted in the analysis, through bibliographic research, about the duality between civilization and barbarism through the permeation of the criminal state in contemporary times and its relations with the Universal Declaration of Human Rights, using the perspective of the Female Prison System in Brazil. For this analysis were addressed themes related to sexism, racism, capitalism and the restricted action of preeminent human rights in the social and hierarchical status quo which the Penal State maintains. In view of this, the emergence of a punitive culture advocated by political instances reinforces the construction of more “kidnapping institutions” through a manifestation of the State in maintaining hierarchical power in the face of the detainees' individuality, depriving them of their rights and fixing this subjection to the disciplinary structure in which the lack of basic resources for their physical and psychological health predominates. Thus, the main purpose of the article was to open the discussion about who human rights are concerned about and to question prison institutions through the idea of criminal abolitionism, using studies in Social Psychology and authors such as Michel Foucault, Katie Arguello, Drauzio Varella and Angela Davis.

Para esa análisis fueron elencados puntos sobre sexismo, racismo y la detallado acción de los derechos humanos inherentes en el ‘’status quo’’ social y hierarquizado por el cual el Estado Penal mantiene. Frente a eso el comienzo de una cultura punitiva preconizado por las instancias políticas que refuerza la construcción de más ‘’instituciones de secuestro’’ a traves de una manifestación del Estado en mantener el poder hierárquico delante de la individualidad de las detenidas limitandolas de sus derechos y fijando esa sujeción a la estructura diciplinar en que predomina la falta de recursos básicos para su salud física y psicológica. Así el punto principal del artículo fue empezar la discusión sobre para quién se volveran los derechos humanos y reflejar las instituciones prisionales a traves medio de la idea de abolicionismo penal utilizando de los estudios en Psicologia Social y autores como Michel Foucalt, Katie Arguello, Drauzio Varella y Angela Davis.Este artigo consiste na análise, por meio de pesquisa bibliográfica, acerca da dualidade entre civilização e barbárie, através da permeação do Estado penal na contemporaneidade e suas relações com a Declaração Universal dos Direitos humanos, utilizando da ótica do Sistema Prisional Feminino no Brasil. Para essa análise, foram abordados temas referentes ao sexismo, racismo, capitalismo e a restrita ação dos Direitos humanos, preeminentes no status quo social e hierarquizado ao qual o Estado penal mantém. Frente a isso, o surgimento de uma cultura punitiva preconizada pelas instâncias políticas reforça a construção de mais “instituições de sequestro” através de uma manifestação do Estado em manter o poder hierárquico diante da individualidade das detentas, privando-as de seus direitos e fixando essa sujeição à estrutura disciplinar em que predomina a falta de recursos básicos para sua saúde física e psicológica.
