Resumo: The most relevant aspects of this study fall on the quota system (Law nº 8.112/90 and Law nº 8.213/91) and the analysis of access to the labor market by people with disabilities (PCD), substantiating the qualitative aspect in Law nº 13.146/2015. In this context, the research question is limited to questioning whether the foundation of the application of the fundamental right to the existential maximum is present in work relationships directed to PCD through the Quota System? The objective is to analyze from a qualitative point of view the quota system aimed at PCD in the labor market, using relevant aspects of the fundamental right to the existential maximum for the direction and strategies of inclusion, based on different approaches to equality as a process of respect. the difference. The research has a descriptive nature, which deals with phenomena that are little known or that are not yet very clear, due to their degree of complexity, fragmentation and interconnections, based on the qualitative method, according to which data analysis is an effective instrument to expand knowledge about the researched subject. Data were collected in literary bases of broad and diversified works, as well as in legislation, official government websites and online events. Thus, the main results obtained reverberated in verifying that the group object of study needs special attention, due to their vulnerabilities, concerning the restriction of locomotion, vision, hearing, among others, seeking to implement the right to equality and the fundamental right to the maximum existential within working conditions, considering that these rights will attract, by way of accessory, the duty of solidarity, accessibility, social justice, in order to guarantee a dignified life for the disabled person and in order to avoid the state of objectification of the human being.

En ese contexto, la pregunta de investigación se limita a cuestionar si el fundamento de la aplicación del derecho fundamental al máximo existencial está presente en las relaciones de trabajo dirigidas a los PCD a través del Sistema de Cuotas. O objetivo é analisar sob o ponto de vista qualitativo o sistema de cotas direcionado à PCD no mercado de trabalho, utilizando aspectos relevantes do direito fundamental ao máximo existencial para o direcionamento e estratégias de inclusão, com base nas diferentes abordagens da igualdade como processo de respeito la diferencia. La investigación tiene un carácter descriptivo, que trata de fenómenos poco conocidos o aún no muy claros, por su grado de complejidad, fragmentación e interconexiones, basada en el método cualitativo, según el cual el análisis de datos es un instrumento eficaz para ampliar conocimientos sobre el tema investigado. Los datos fueron recolectados en bases literarias de obras amplias y diversificadas, así como en legislación, sitios web oficiales del gobierno y eventos en línea. Assim, os principais resultados obtidos reverberaram em verificar que o grupo objeto de estudo precisa de atenção especial, devido às suas vulnerabilidades, concernentes à restrição de locomoção, visão, audição, dentre outras, buscando efetivar o direito à igualdade e o direito fundamental ao máximo existencial dentro das condições de trabalho, tendo em vista que estes direitos atrairão por acessoriedade, o dever de solidariedade, a acessibilidade, a justiça social, de forma a garantir uma vida digna à pessoa com deficiência e a fim de evitar o estado de coisificação do ser humano.Os aspectos mais relevantes deste estudo recaem sobre o sistema de cotas (Lei nº 8.112/90 e Lei nº 8.213/91) e a análise do acesso ao mercado de trabalho pelas pessoas com deficiência (PCD), consubstanciando o aspecto qualitativo na Lei nº 13.146/2015. Nesse contexto, a questão de pesquisa cinge-se em questionar se a fundamentação da aplicação do direito fundamental ao máximo existencial, está presente nas relações de trabalho direcionadas à PCD por meio do Sistema de Cotas? O objetivo é analisar sob o ponto de vista qualitativo o sistema de cotas direcionado à PCD no mercado de trabalho, utilizando aspectos relevantes do direito fundamental ao máximo existencial para o direcionamento e estratégias de inclusão, com base nas diferentes abordagens da igualdade como processo de respeito à diferença. A pesquisa possui natureza descritiva, que trata de fenômenos pouco conhecidos ou que ainda não sejam muito claros, pelo seu grau de complexidade, fragmentação e interligações, alicerçando-se no método qualitativo, segundo o qual a análise de dados é um instrumento eficaz para ampliar o conhecimento sobre o assunto pesquisado. Os dados foram coletados em bases literárias de obras amplas e diversificadas, bem como em legislações, sites oficiais do governo e eventos online.
