The reflection of social inequality in the rates of infractions in Brazil

Resumo: This research aims to demonstrate the relationship between Social Inequality in the country and the increase in the rates of Infractions. This relationship is demonstrated through notes about the violation of the Doctrine of Integral Protection - one of the basic principles that govern the Rights of Children and Adolescents - and Human Dignity, as well as through statistical data on the economic and psychological conditions in where children and adolescents who commit Infractional Acts are found. In addition, it explains the influence of family structure in the practice of these Acts. Faced with the violation of this principle and the family and affective lack faced, many children and adolescents begin to practice Infractional Acts, as a way of filling this lack and in some cases, as a way of survival. With this, the general objective of the research is to demonstrate the influence of the social context in which the individual who practices Infractions is inserted. Specifically, it seeks to draw notes about the violation of the Principles of Human Dignity and Comprehensive Protection; to discuss the situation of social vulnerability in which children and adolescents who are perpetrators of Infractional Acts find themselves; to analyze studies with regard to the relationship and influence between the lack of family structure and the practice of infractions. To this end, bibliographic research and statistical data on social inequality and infractions were used. In this sense, the Social Inequality index in the last 20 years directly reflected the increase in Infractions in Brazil.

Esta relación se demuestra a través de notas sobre la vulneración de la Doctrina de la Protección Integral -uno de los principios básicos que rigen los Derechos de la Niñez y la Adolescencia- y la Dignidad Humana, así como a través de datos estadísticos sobre las condiciones económicas y psicológicas en que se encuentran los niños y niñas. se encuentran adolescentes que cometen Actos Infractores. Además, explica la influencia de la estructura familiar en la práctica de estas Leyes. Ante la vulneración de este principio y la carencia familiar y afectiva enfrentada, muchos niños y adolescentes comienzan a practicar Actos Infractores, como forma de suplir esta carencia y en algunos casos, como forma de sobrevivencia. Con ello, el objetivo general de la investigación es demostrar la influencia del contexto social en el que se inserta el individuo que practica las Infracciones. Específicamente, busca sacar notas sobre la vulneración de los Principios de Dignidad Humana y Protección Integral; discutir la situación de vulnerabilidad social en que se encuentran los niños, niñas y adolescentes autores de Actos Infractores; analizar los estudios sobre la relación e influencia entre la desestructuración familiar y la práctica de las infracciones. Para ello, se utilizaron investigaciones bibliográficas y datos estadísticos sobre desigualdad social e infracciones. En ese sentido, el índice de Desigualdad Social en los últimos 20 años reflejó directamente el aumento de las Infracciones en Brasil.A presente pesquisa visa demonstrar a relação entre a Desigualdade Social no país e o aumento nos índices de Atos Infracionais. Essa relação é demonstrada por meio de apontamentos acerca da violação da Doutrina da Proteção Integral - um dos princípios basilares, que regem o Direito das Crianças e Adolescentes – e da Dignidade Humana, bem como por meio dos dados estatísticos sobre as condições econômicas e psicológicas em que se encontram as crianças e adolescentes autores de Atos Infracionais. Além disso, explana a influência da estrutura familiar na prática desses Atos. Diante da violação desse princípio e da carência familiar e afetiva enfrentada, muitas crianças e adolescentes, passam a praticar Atos Infracionais, como forma de suprir essa carência e em alguns casos, como forma de sobrevivência. Com isso, o objetivo geral da pesquisa é demonstrar a influência do contexto social em que se está inserido o indivíduo que pratica Atos Infracionais. Especificamente busca-se traçar apontamentos acerca da violação dos Princípios da Dignidade Humana e da Proteção Integral; discutir sobre a situação de vulnerabilidade social em que se encontra as crianças e adolescentes autoras de Atos Infracionais; analisar estudos no que diz respeito à relação e influência entre a falta de estrutura familiar e a prática de Atos infracionais. Para tanto, utilizou-se de pesquisa bibliográfica e de dados estatísticos sobre desigualdade social e atos infracionais.
