The fundamental right to education: an analysis of constitutional provisions in contrast to the factual reality

Resumo: | This study aims to analyze the dynamics of human rights, based on the Brazilian democratic platform established with the Federal Constitution of 1988, especially with regard to the fundamental right to education. With this, the limits of the democratic regime are pointed out as a field for the recognition and affirmation of human rights in Brazil, in concomitant application with the current constitutional legislation. In this perspective, this article, through descriptive research, of qualitative nature, deductive method, collection of bibliographic-documentary data, was carried out in order to perform a historical analysis of the right to education in the light of the Universal Declaration of Human Rights, as well as the Federal Constitution of 1988, mainly regarding the evolution of the right to education in Brazilian constitutionalism, in order to highlight the growth of the State's commitment to this right. Nevertheless, it also clarified the main incongruities regarding the quality of Brazilian education, which, despite the constitutional text will be arranged as a fundamental right that must be promoted by the State, is not effectively realized, being of relevant scientific interest the finding of the ins and outs that Brazilian education is conducted by the State. Moreover, it is noteworthy that, through the analysis of the sample indexes of the Brazilian educational quality, such as the IDEB, the verification of the real effectiveness of this right was asked. Finally, in view of the problem exposed, we sought, based on constitutional principles, to elucidate the need of the State, based on the defense of human rights and respect for social well-being, seeking the fostering of public policies as a way of social promotion. |

Este estudio tiene como objetivo analizar la dinámica de los derechos humanos, basado en la plataforma democrática brasileña establecida con la Constitución Federal de 1988, especialmente en lo que respecta al derecho fundamental a la educación. Con esto, los límites del régimen democrático se señalan como un campo para el reconocimiento y la afirmación de los derechos humanos en Brasil, en aplicación concomitante con la legislación constitucional vigente. En esta perspectiva, este artículo, a través de la investigación descriptiva, de naturaleza cualitativa, método deductivo, recopilación de datos bibliográficos-documentales, se llevó a cabo con el fin de realizar un análisis histórico del derecho a la educación a la luz de la Declaración Universal de Derechos Humanos, así como la Constitución Federal de 1988, principalmente en lo que respecta a la evolución del derecho a la educación en el constitucionalismo brasileño, con el fin de destacar el crecimiento del compromiso del Estado con este derecho. No obstante, también aclaró las principales incongruencias con respecto a la calidad de la educación brasileña, que, a pesar del texto constitucional, se organizará como un derecho fundamental que debe ser promovido por el Estado, no se realiza efectivamente, siendo de interés científico relevante el hallazgo de los entresimientos de que la educación brasileña es llevada a cabo por el Estado. Además, cabe destacar que, mediante el análisis de los índices de muestra de la calidad educativa brasileña, como el IDEB, se solicitó la verificación de la eficacia real de este derecho. Por último, en vista del problema expuesto, buscamos, sobre la base de principios constitucionales, esclarecer la necesidad del Estado, basada en la defensa de los derechos humanos y el respeto del bienestar social, buscando el fomento de las políticas públicas como forma de promoción social.O presente estudo vislumbra analisar a dinâmica dos direitos humanos, a partir da plataforma democrática brasileira instaurada com a Constituição Federal de 1988, sobretudo no que concerne ao direito fundamental à educação. Com isso, apontam-se os limites do regime democrático como campo para o reconhecimento e a afirmação dos direitos humanos, no Brasil, em aplicação concomitante com a legislação constitucional vigente. Nessa perspectiva, este artigo, através da pesquisa descritiva, de natureza qualitativa, método dedutivo, coleta de dados bibliográfico-documental, procedeu-se de modo a realizar uma análise histórica do direito à educação à luz da Declaração Universal dos Direitos Humanos, bem como da Constituição Federal de 1988, principalmente no tocante à evolução do direito à educação no constitucionalismo brasileiro, de forma a evidenciar o crescimento do compromisso do Estado para com este direito. Não obstante, elucidou também as principais incongruências no que tange à qualidade da educação brasileira que, malgrado no texto constitucional venha a ser disposto como um direito fundamental que deve ser promovido pelo Estado, não é efetivamente concretizado, sendo de relevante interesse científico a constatação dos meandros que a educação brasileira é conduzida pelo Estado. Outrossim, destaca-se que inquiriu-se, através da análise dos índices de amostra da qualidade educacional brasileira, como o IDEB, a verificação da real efetividade desse direito.
