Public administration and inspection of concessionaires: a case study

Resumo: | The Brazilian Government lack of capacity to provide basic public services led to the need to employ the concession mechanism as provided by law, where the granting authority sets the maximum tariff to be charged for services and controls and inspects their quality from a set of predefined parameters to be inspected as mentioned in the concession contract. The objective of the present work is to present a useful procedure for the Public Administration to evaluate basic services in a concession system based on information obtained from users. It is a theoretical-empirical work which includes a bibliographic research, the pertinent legislation, and a field research, where semi-structured questionnaires were applied to the direct and to indirect users of urban public transport system by bus. Confirming the analyzed theoretical framework, the opinion of users establishes as a reliable source to assess the quality of services, being an excelent instrument for inspecting public services concessions. |

Confirming the analyzed theoretical framework, the opinion of users establishes as a reliable source to assess the quality of services, being an excelent instrument for inspecting public services concessions.La falta de capacidad del Gobierno brasileño para proporcionar servicios públicos básicos a la sociedad llevó a la necesidad de emplear el mecanismo de concesión según lo dispuesto por ley, donde la autoridad otorgante establece la tarifa máxima a cobrar por los servicios y regula e inspecciona la calidad de los mismos, a partir de un conjunto de parámetros a ser inspeccionados y mencionados en el contrato de concesión. El objetivo del presente trabajo es presentar un procedimiento útil para que la Administración Pública evalúe los servicios básicos oferecidos por terceiros con base en información obtenida de los clientes. Se trata de un trabajo teórico-empírico que incluye una investigación bibliográfica, legislación pertinente, y un estudio de campo, donde se utilizaron cuestionarios semiestructurados, aplicados conjuntamente a los usuarios directos e indirectos del sistema de transporte público urbano en autobús. Confirmando el marco teórico analizado, la opinión de los usuarios se establece como una fuente confiable para evaluar la calidad de los servicios, demostrando ser un buen instrumento para inspeccionar las concesiones de servicios públicos.A falta de capacidade do Governo do Estado Brasileiro para prestar serviços públicos básicos, levou a necessidade de empregar o mecanismo de concessão conforme previsto em lei, onde o poder concedente fixa a tarifa máxima a ser cobrada pelos serviços e regula e fiscaliza a qualidade do mesmo, a partir de um conjunto de parâmetros a serem fiscalizados e mencionados no contrato da concessão. O objetivo do presente trabalho é apresentar um procedimento útil para a Administração Pública avaliar os serviços básicos em sistema de concessão, a partir de informações obtidas dos usuários. Trata-se de um trabalho teórico-empírico embasado numa pesquisa bibliográfica e na Legislação pertinente, e inclui uma pesquisa de campo, onde foram utilizados questionários semiestruturados, aplicados juntos aos usuários diretos e indiretos do sistema de transporte público urbano por ônibus.
