Human and Fundamental Right to access to justice: analysis of jus postulandi and the indispensability of the lawyer from the perspective of personality rights

Resumo: The article aims to reflect on human rights, fundamentals and personality, in order to trace its relationship with the right to access to justice in the exercise of jus postulandi and its effectiveness. For the accomplishment of this work, the hypothetical deductive method approach was used, with bibliographic research in books, periodical publications, scientific articles, printed, national and international legislation. In the end it was concluded that the jus postulandi presents weaknesses that obstruct access to just justice. Also, the performance of the lawyer is essential for the realization of these rights, as well as the dignity of the human person.

Also, the performance of the lawyer is essential for the realization of these rights, as well as the dignity of the human person.El artículo tiene como objetivo reflexionar sobre los derechos humanos, fundamentales y de la personalidad, a fin de trazar su relación con el derecho de acceso a la justicia en el ejercicio del jus postulandi y su efectividad.Para la realización de este trabajo se utilizó el enfoque del método hipotético deductivo, con investigación bibliográfica para su realización, en libros, publicaciones periódicas, artículos científicos, artículos impresos, legislación nacional e internacional. Al final, se concluyó que el jus postulandi presenta debilidades que dificultan el acceso a una justicia justa. Asimismo, la actuación del abogado es fundamental para la realización de estos derechos, así como la dignidad de la persona humana.O artigo tem como objetivo refletir sobre os direitos humanos, fundamentais e da personalidade, a fim de traçar sua relação com o direito ao acesso à justiça no exercício do jus postulandi e sua efetividade. Para realização deste trabalho foi utilizada a abordagem do método hipotético dedutivo, com a pesquisa bibliográfica em livros, publicações periódicas, artigos científicos, impressos, legislação nacional e internacional. Ao final chegou-se a conclusão que o jus postulandi apresenta fragilidades que obstruem o acesso à justiça justa.
