Resumo: The present work aims to analyze the achievements and challenges facing the overcoming of the welfare character in Early Childhood Education. To achieve the proposed objective, we stop to rescue the history of Early Childhood Education from its origin, linked to the Industrial Revolution, to the achievements in the context of public educational policies. The theoretical approach has as main authors Dias, Didonet, Kuhlmann Jr., Marcilio and Paschoal and Machado, which deal with the historical context of Early Childhood Education and the right of young children to education. From the methodological point of view, it is a qualitative research, with an exploratory and documentary nature. Regarding the results, we infer that the care for young children, outside the family, appears in the context of the development of capitalism and industrialization. Early Childhood Education, in turn, has its origins marked by assistentialism, strongly characterized by the custody, care, feeding and hygiene of young children. Faced with this reality, it was possible to verify that, despite the advances in favor of guaranteeing a quality education as a subjective right of the young child, there are still many challenges to be faced and many advances to be achieved in favor of the effectiveness of the public policies in Early Childhood Education.

Para lograr el objetivo propuesto, nos detenemos a rescatar la historia de la Educación Infantil desde su origen, ligado a la Revolución Industrial, hasta los logros en el contexto de las políticas públicas educativas. El abordaje teórico tiene como autores principales a Dias, Didonet, Kuhlmann Jr., Marcilio y Paschoal y Machado, que tratan sobre el contexto histórico de la Educación Infantil y el derecho de los niños pequeños a la educación. Desde el punto de vista metodológico, se trata de una investigación cualitativa, de carácter exploratorio y documental. En cuanto a los resultados, inferimos que el cuidado de los niños pequeños, fuera de la familia, aparece en el contexto del desarrollo del capitalismo y la industrialización. La Educación Infantil, por su parte, tiene sus orígenes marcados por el asistencialismo, fuertemente caracterizado por la custodia, cuidado, alimentación e higiene de los niños pequeños. Ante esta realidad, se pudo constatar que, a pesar de los avances a favor de garantizar una educación de calidad como derecho subjetivo de la niñez, aún quedan muchos desafíos por enfrentar y muchos avances por lograr a favor de la efectividad. de las políticas públicas en Educación Infantil.O presente trabalho tem como objetivo analisar as conquistas e desafios frente à superação do caráter assistencialista na Educação Infantil. Para atingir o objetivo proposto, detemo-nos ao resgate da história da Educação Infantil desde a sua origem, ligada à Revolução Industrial, até as conquistas no contexto das políticas públicas educacionais. A abordagem teórica tem como principais autores Dias, Didonet, Kuhlmann Jr., Marcilio e Paschoal e Machado, que tratam do contexto histórico da Educação Infantil e do direito da criança pequena à educação. Do ponto de vista metodológico, trata-se de uma pesquisa de natureza qualitativa, de cunho exploratório e documental. No tocante aos resultados, inferimos que o atendimento à criança pequena, fora do seio familiar, surge diante do contexto de desenvolvimento do capitalismo e da industrialização. A Educação Infantil, por sua vez, tem suas origens marcadas pelo assistencialismo, caracterizado fortemente pela guarda, cuidado, alimentação e higiene das crianças de tenra idade.
