Administrative defense in the environmental sphere: an analysis based on actions in Rondônia

Resumo: The present study proposes a reflection based on the challenges that Brazilian Environmental Law currently experiences in view of the complexities and dynamics scenario involving the exploitation of natural resources. For the present study, the research method of bibliographic analysis was used, using as references the Constitution of the Federative Republic of Brazil of 1988 and the National Environmental Policy Law. In the first part of the text, a brief history of environmental law is presented, where the basic principles of environmental law and the types of infractions are listed. Next, it discusses how the administrative process begins, and, starting from the assessment, the structure of the administrative process is presented, as well as deadlines, and ends with the forms of defense and resources, and types of sanctions that can be applied.

También se propone identificar la sungularidad del proceso administrative dirigido a la finalidad de proteger el medio ambiente. Para el presente análisis se utilize el método de investigación de análisis bibliográfico, tomando como referencias la Constitución de la Republica Federativa de Brasil de 1988  y la Ley de Política Nacional Ambiental. En la primera parte del texto se presenta una breve historia del derecho Ambiental donde se enumera los principios básicos del derecho Ambiental y los tipos de infracciones. A continuación, se discute cómo se inicia el processo administrative y, a partir de la evaluación, se presenta la estructura del processo administrative. Concluye con formas de defensa y recursos, y tipos sanciones que se pueden aplicar.O presente estudo propõe uma reflexão a partir dos desafios que o Direito Ambiental brasileiro experimenta na atualidade diante do cenário de complexidades e dinâmicas envolvendo a exploração dos recursos naturais. Propõem-se ainda identificar a singularidade do processo administrativo direcionado ao propósito de proteção do meio ambiente. Para a presente análise, lançou-se mão do método de pesquisa de análise bibliográfica usando como referências a Constituição da República Federativa do Brasil de 1988 e a Lei da Política Nacional do Meio Ambiente. Na primeira parte do texto apresenta-se um breve histórico sobre o direito ambiental, onde são elencados os princípios basilares do direito ambiental e as tipologias das infrações. Na sequência aborda-se como se inicia o processo administrativo, e, partindo da autuação, apresenta-se a estrutura do processo administrativo.
