Resumo: This article aims to analyze the new sanitation framework and the possible impacts on small Brazilian municipalities. Therefore, a study of the entire bibliography already published was carried out, in the form of magazines, books, written press and separate publications. The results showed that the new sanitation framework represents a setback from the point of view of social rights, since it stimulates the mercantilist logics in the management of water and sanitation services. Experiences in the world show that universalization is not possible without democratic management and the contribution of public resources. The conclusion is reached that private companies will prioritize rich cities, forgetting small municipalities, as private companies are guided by profit, because this is the reason for their activity. In this aspect, the New Marco may have more doubts and obstacles than certainties. Furthermore, in Law No. 14,026 of 2020, there are several unconstitutional articles that affect the autonomy and organization of municipalities and affect the federative pact. In this context, there are several Direct Unconstitutionality Actions with the STF so that the New Sanitation Framework is declared incompatible with the Brazilian legal system. In this way, the aim is to ensure that basic sanitation services are offered exclusively by the government. This is because the main purpose of this power is to act in favor of the collectivity.

Por tanto, se realizó un estudio de toda la bibliografía ya publicada, en forma de revistas, libros, prensa escrita y publicaciones independientes. Los resultados mostraron que el nuevo marco de saneamiento representa un retroceso desde el punto de vista de los derechos sociales, ya que estimula las lógicas mercantilistas en la gestión de los servicios de agua y saneamiento. Las experiencias en el mundo muestran que la universalización no es posible sin una gestión democrática y el aporte de recursos públicos. Se llega a la conclusión de que las empresas privadas priorizarán las ciudades ricas, olvidándose de los pequeños municipios, ya que las empresas privadas se guían por el lucro, porque ese es el motivo de su actividad. En este aspecto, el Nuevo Marco puede tener más dudas y obstáculos que certezas. Además, en la Ley N ° 14.026 de 2020 existen varios artículos inconstitucionales que atentan contra la autonomía y organización de los municipios y afectan el pacto federativo. En este contexto, existen varias Acciones Directas de Inconstitucionalidad con el STF para que el Nuevo Marco de Saneamiento sea declarado incompatible con el ordenamiento jurídico brasileño. De esta forma, se busca asegurar que los servicios básicos de saneamiento sean ofrecidos exclusivamente por el gobierno. Esto se debe a que el propósito principal de este poder es actuar a favor de la colectividad.O presente artigo objetiva analisar o novo marco de saneamento e os possíveis impactos nos pequenos municípios brasileiros. Para tanto foi realizado um estudo de toda a bibliografia já publicada, em forma de revistas, livros, imprensa escrita e publicações avulsas. Os resultados mostraram que o novo marco do saneamento representa um retrocesso, sobre o ponto de vista dos direitos sociais, uma vez que em que estimula as lógicas mercantilistas na gestão dos serviços de água e saneamento. As experiências no mundo evidenciam que a universalização não é possível acontecer sem uma gestão democrática e aporte de recursos públicos. A conclusão que se chega que as empresas privadas vão priorizar cidades ricas, esquecendo os municípios pequenos, pois a empresa privada se orienta pelo lucro, porque esta é a razão de sua atividade. Nesse aspecto, o Novo Marco pode ter mais dúvidas e entraves do que certezas. Além disso na Lei nº 14.026 de 2020 existem vários artigos inconstitucionais que ferem autonomia e a organização dos municípios e afetam o pacto federativo. Nesse contexto, existem diversas Ações Diretas de Inconstitucionalidade junto ao STF para que o Novo Marco do Saneamento seja declarado incompatível com o ordenamento jurídico brasileiro. Dessa forma, busca-se assegurar que os serviços de saneamento básicos sejam ofertados exclusivamente pelo poder público.
