Resumo: The purpose of this article is to study Law n°. 9,263/96, which regulates the constitutional right to family planning, focusing on the provisions that establish requirements for voluntary sterilization, foreseen in art. 10, I and §5th. Based on the assumption that the current rules governing voluntary sterilization in Brazil are unjustifiably restrictive, the objective is to confront the law under examination with constitutional norms-principles. The present work was based on qualitative research and literature review, and with the application of deductive method, the results of the work showed that there is incompatibility between the infraconstitutional provisions examined and the Constitution, having the fragments under analysis unconstitutional.

Basado en el supuesto de que las normas actuales que rigen el acto de esterilización voluntaria en Brasil son injustificadamente restrictivas, el objetivo era confrontar la ley bajo examen con las normas y principios constitucionales. El presente estudio se basó en la investigación cualitativa y la revisión de la literatura, y con la aplicación de un método deductivo, los resultados del estudio demostraron que existe incompatibilidad entre las disposiciones infraconstitucionales examinadas y la Constitución, cubriendo los fragmentos bajo análisis con inconstitucionalidad.O presente artigo tem como objeto de estudo a Lei nº 9.263/96, que regula o direito constitucional ao planejamento familiar, posicionando seu enfoque nos dispositivos que estabelecem requisitos para a realização da esterilização voluntária, quais sejam o seu art. 10, I e §5º. Partindo-se da suposição de que as atuais regras que disciplinam o ato de esterilização voluntária no Brasil são injustificadamente restritivas, objetivou-se confrontar a lei em exame com normas-princípios constitucionais.
