The construction of the expert report over time: disputes for power in the framework of criminal prosecution

Resumo: The objective of this work was to analyze the historicity of the structure of the official expert report, of a criminal nature, showing how the power of the agents involved in the criminal prosecution were shaping the structure of this legal document. For this purpose, a comparison of the structure of the actual reports with the reports produced in the period from 1890 to 1930 was carried out. The analysis showed temporal continuities in the writing of the report at least 150 years ago. In Brazil, the structure of the forensic report was being delineated within the criminal process in view of the inquisitorial and notary logic of registration and written authentication of documents. So, the forensic report have incorporated certain organizational and hierarchical structures that were preserved and reinforced by the legal framework. These preserved structures reflect disputes of power and influence over the forensic science that has been perpetuated until the present day, establishing restrictions and discontinuities of the forensic science act.

Por lo tanto, se realizó una comparación de la estructura de los informes actuales con los informes producidos en el período de 1890 a 1930. El análisis mostró continuidades temporales en la redacción del informe pericial durante al menos 150 años. En Brasil, la estructura del informe pericial fue diseñada dentro del proceso criminal, teniendo en cuenta la lógica inquisitorial y notarial de registro y autenticación escrita de documentos y, al hacerlo, pasó a incorporar ciertas estructuras de organización y jerarquía. Estas estructuras conservadas y reforzadas por el marco legal, reflejan disputas de poder e influencia sobre la pericia que se perpetúan hasta nuestros días, estableciendo restricciones y discontinuidades del acto pericial.O objetivo desse trabalho foi analisar a historicidade da estrutura do laudo pericial oficial, de natureza criminal, evidenciando como o poder dos agentes envolvidos na persecução penal foram moldando a estrutura desse documento legal. Para tanto foi realizada uma comparação da estrutura dos laudos atuais com os laudos produzidos no período de 1890 a 1930. A análise mostrou continuidades temporais na escrita do laudo há pelo menos 150 anos. No Brasil, a estrutura do laudo pericial foi sendo delineada dentro do processo criminal atendendo à lógica inquisitorial e cartorária de registro e autenticação escrita de documentos e, ao fazê-lo, passou a incorporar determinadas estruturas de organização e hierarquização.
