The ineffectiveness of applying fines and their conversion in environmental services

Resumo: This work consists of an analysis of the effectiveness of the conversion of fines into environmental services in relation to the payment for environmental fines, specifically regarding the program of conversion of environmental fines, compared to the condemnation to pay only the fines and their collection.Exploratory and explanatory literature review studies were used, as well as normative analysis related to the theme. It was found that the traditional procedure of applying an environmental fine collect less than necessary to repair damage to the environment, in view of the judicial delays and the factor of prescription, representing obstacles to the repair of environmental damage.On the other hand, the possibility of converting a fine into environmental services shows advantages for both the assessed taxpayer and the Public Administration, allowing the formulation of an agreement between the environmental agency and the offender for the full reparation of environmental damage, without the obligation to resort to Judiciary, saving time and resources, providing even greater participation of the offender in environmental projects, resulting in environmental education to prevent future infractions.

Se utilizaron estudios de revisión bibliográfica exploratoria y explicativa, así como análisis normativos relacionados con el tema. Se verificó que el procedimiento tradicional de aplicación de multas ambientales cobra menos valor del necesario para reparar el daño al medio ambiente, en vista de las demoras judiciales y el instituto de la prescripción, que representan obstáculos para la reparación del daño ambiental. Por otro lado, la posibilidad de convertir una multa en un servicio ambiental evidencia ventajas tanto para el demandado como para la Administración Pública, permitiendo la formulación de un acuerdo entre el organismo ambiental y el infractor para la reparación integral del daño ambiental, sin la obligación de recurrir al Poder Judicial, ahorrando tiempo y recursos, proporcionando una participación aún mayor del infractor en los proyectos ambientales, resultando en la educación ambiental para la prevención de futuras infracciones.Este trabalho constitui-se em uma análise da efetividade da conversão de multas em serviços ambientais em relação ao pagamento por multas ambientais, especificamente quanto ao programa de conversão de multas ambientais comparado à condenação ao pagamento apenas às multas e sua arrecadação. Utilizou-se de estudos de revisão bibliográfica de caráter exploratório e explicativo e ainda de análise normativa referente ao tema. Verificou-se que o procedimento tradicional de aplicação de multa ambiental arrecada valor inferior ao necessário para reparação de danos ao meio ambiente, tendo em vista às protelações judiciais e ao instituto da prescrição, representando entraves à reparação do dano ambiental.
