Institutions and professional associations of nursing categories: proposal of a pedagogical intervention for the contents of Ethics and Professional Legislation

Resumo: This work presents a proposal for a pedagogical intervention focused on the contents of ethics and professional legislation of technical courses in nursing. The National Curriculum Guidelines for Technical Vocational Education at Middle Level determine that the professional profile of completion must consider and contemplate the functional attributions provided for in the specific legislation regarding the supervised professional exercise (RESOLUTION 06/2012/CEB/CNE/MEC). The main nursing regulations are Law No. 7,498, of June 25, 1986, and Decree No. 94,406, of June 8, 1987. After approaching legal issues related to the practice of nursing, this work proposes a set of didactic activities that have as main objective to assist the student body in the pedagogical process of knowledge/reflection and autonomy to research and identify in the Brazilian legal system the norms that deal with the legal nature and the actions performed by the nursing supervision institutions (Federal Nursing Council and Regional Councils of Nursing), as well as class entities, such as associations and unions. In this vein, with the aim of clarifying and enriching the contents, principles related to basic notions of formalities for the effectiveness of the rights and duties of the CLT worker or public servant were briefly discussed.

Los Lineamientos Curriculares Nacionales de la Educación Técnica Profesional de Nivel Medio determinan que el perfil profesional de egreso debe considerar y contemplar las atribuciones funcionales previstas en la legislación específica sobre el ejercicio profesional supervisado (RESOLUCIÓN 06/2012/CEB/CNE/MEC). Las principales normas de enfermería son la Ley N° 7.498, de 25 de junio de 1986, y el Decreto N° 94.406, de 8 de junio de 1987. Luego de abordar cuestiones legales relacionadas con el ejercicio de la enfermería, este trabajo propone un conjunto de actividades didácticas que tienen como objetivo principal auxiliar al estudiantado en el proceso pedagógico de conocimiento/reflexión y autonomía para investigar e identificar en el ordenamiento jurídico brasileño las normas que tratan sobre la naturaleza jurídica y las acciones realizadas por las instituciones de supervisión de enfermería (Consejo Federal de Enfermería y Consejos Regionales de Enfermería), así como entidades de clase, como asociaciones y sindicatos. En este sentido, con el objetivo de esclarecer y enriquecer los contenidos, se discutieron brevemente principios relacionados con nociones básicas de formalidades para la efectividad de los derechos y deberes del trabajador o servidor público de CLT.Este trabalho apresenta uma proposta de intervenção pedagógica voltada para os conteúdos de ética e legislação profissional dos cursos técnicos em enfermagem. As Diretrizes Curriculares Nacionais para a Educação Profissional Técnica de Nível Médio determinam que o perfil profissional de conclusão deve considerar e contemplar as atribuições funcionais previstas na legislação específica referente ao exercício profissional fiscalizado (RESOLUÇÃO 06/2012/CEB/CNE/MEC). Os principais regulamentos da enfermagem são a Lei nº 7.498, de 25 de junho de 1986 e o Decreto nº 94.406, de 8 de junho de 1987. Após abordagem de temas jurídicos relacionados ao exercício da enfermagem, este trabalho propõe um conjunto de atividades didáticas que possuem por principal objetivo auxiliar o corpo discente no processo pedagógico de conhecimento/reflexão e autonomia para pesquisar e identificar no ordenamento jurídico brasileiro as normas que tratam sobre natureza jurídica e as ações desempenhadas pelas instituições de fiscalização da enfermagem (Conselho Federal de Enfermagem e Conselhos Regionais de Enfermagem), bem como das entidades classistas, como as associações e sindicatos.
