The evolution of environmental legislation in the Brazilian historical context

Resumo: | The objective of this work is to evaluate the evolution of environmental legislation within the Brazilian historical and economic context. For this purpose, different historical periods of Brazil were analyzed: the period of ordinations, the imperial period of Brazil, the Old Republic, the republican period, the decades of 1930, 1960, 1970, 1980, 1990 and the two decades of the 21st century. Initially Brazil imported the first environmental protection laws of Portugal. In some historical moments, environmental protection should not sacrifice the country's economic development, they constituted the main obstacles to the insertion of the sustainability component in the Brazilian economic development model. From the 1960s on, a season was started with good and advanced environmental devices, but ineffective, because the population did not yet have a sense of ownership and the appreciation of prevention and support of future generations. In the 1990s the legislation has integralizing characteristics, that is, it combines economic and social aspects with environmental aspects in order to preserve the Environment and meet the Federal Constitution. In the 21st century. XXI, with globalization, the global environmental pressure is to associate production, values and preservation of natural resources. This process of evolution of environmental legislation is a dynamic step and requires constant improvements, especially in the aspects of support for the implementation of legislation, such as supervision and technical staff of the managing bodies. Avoiding the setback is the greatest challenge in maintaining the constant evolution that the laws demand in the contemporary scenario. |

El objetivo de este trabajo es evaluar la evolución de la legislación ambiental en el contexto histórico y económico brasileño. Para ello, se analizaron diferentes períodos históricos de Brasil: el período de ordenación, el período imperial de Brasil, la Antigua República, el período republicano, las décadas de 1930, 1960, 1970, 1980, 1990 y las dos décadas del siglo XXI. Inicialmente, Brasil importó las primeras leyes de protección ambiental de Portugal. En algunos momentos históricos, la protección del medio ambiente no debe sacrificar el desarrollo económico del país, fueron los principales obstáculos para la inserción del componente de sostenibilidad en el modelo de desarrollo económico brasileño. A partir de la década de 1960, comenzó una temporada con buenos y avanzados dispositivos ambientales, pero ineficaces, ya que la población aún no tenía el sentimiento de pertenencia y la apreciación de la prevención y el beneficio de las generaciones futuras. En la década de los noventa, la legislación comenzó a tener características integradoras, es decir, combina los aspectos económicos y sociales con los ambientales para preservar el Medio Ambiente y cumplir con la Constitución Federal. En el siglo XXI, con la globalización, la presión ambiental global es asociar producción, valores y preservación de los recursos naturales. Este proceso de evolución de la legislación ambiental es una etapa dinámica que requiere mejoras constantes, especialmente en aspectos que apoyan la implementación de la legislación, como el personal técnico y de inspección de los órganos de gestión. Evitar el retroceso es el mayor desafío para mantener la constante evolución que las leyes exigen en el escenario contemporáneo.O objetivo deste trabalho é avaliar a evolução da legislação ambiental dentro do contexto histórico e econômico brasileiro. Para isso foram analisados diferentes períodos históricos do Brasil: o período de ordenações, o período imperial do Brasil, a República Velha, o período republicano, as décadas de 1930, 1960, 1970, 1980, 1990 e as duas décadas do século XXI. Inicialmente o Brasil importava as primeiras leis de proteção ambiental de Portugal. Em alguns momentos históricos a proteção ambiental não deveria sacrificar o desenvolvimento econômico do país, constituíam os principais entraves para a inserção do componente da sustentabilidade no modelo de desenvolvimento econômico brasileiro. A partir da década de 1960, foi iniciada uma temporada com bons e avançados dispositivos ambientais, porém ineficazes, pois a população ainda não tinha um sentimento de dono e a valorização da prevenção e prol das gerações futuras. Na década de 1990 a legislação passa ter características integralizadoras, ou seja, combina os aspectos econômicos e sociais com os ambientais a fim da preservar o Meio Ambiente e atender a Constituição Federal. No século XXI, com a globalização, a pressão mundial ambiental é para associar produção, valores e preservação dos recursos naturais. Este processo de evolução da legislação ambiental é uma etapa dinâmica e que requer melhorias constantes, sobretudo nos aspectos de apoio à execução da legislação, como fiscalização e corpo técnico dos órgãos gestores.
