Resumo: | The brazilian prison system has been suffering from problems that drastically affect the re-socialization of prisoners. This study considered fundamental rights in the prison context, namely: health, food, hygiene and, especially, education. The study aims to contextualize education in prison through the crisis in Brazilian prisons. It had an exploratory and descriptive narrative review, with a quantitative and qualitative approach. Taking into account the data presented, it is possible to notice that overcrowding has been frequent, with the number of prisoners exceeding that of vacancies in the period from 2017 to 2020. Therefore, there is a neglect of constitutional rights in relation to prisoners through violation of all sorts. It is reiterated that the prisoners must serve their sentences as required by law, but their fundamental rights cannot be relativized, subjecting them to inhuman conditions. The insertion of those sentenced to an education modality is also a way of reducing the time served and, consequently, a way of mitigating the overcrowding of prisons. Education gives these subjects the opportunity to reevaluate their actions, exercising being and acting in society. Finally, allowing prisoners to be able to remit penalties through education is not enough for a proposal for social integration, as education cannot be understood only from this perspective. Therefore, it is really desired that these subjects can reassess their role in society, understanding that being and acting need to respect the space of the other, in the sense that their perspective should be rethought. |

Este estudio consideró los derechos fundamentales en el contexto penitenciario, a saber: salud, alimentación, higiene y, especialmente, educación. El estudio tiene como objetivo contextualizar la educación en prisión a través de la crisis en las cárceles brasileñas. Tuvo una revisión narrativa exploratoria y descriptiva, con enfoque cuantitativo y cualitativo. Teniendo en cuenta los datos presentados, es posible notar que el hacinamiento ha sido frecuente, con un número de presos superior al de vacantes en el período de 2017 a 2020. Por lo tanto, existe un descuido de los derechos constitucionales en relación a los presos por violación de todo tipo. Se reitera que los presos deben cumplir sus penas como exige la ley, pero no se pueden relativizar sus derechos fundamentales, sometiéndolos a condiciones inhumanas. La inserción de los condenados a una modalidad educativa es también una forma de reducir el tiempo cumplido y, en consecuencia, una forma de mitigar el hacinamiento de las cárceles. La educación brinda a estos sujetos la oportunidad de reevaluar sus acciones, ejercitando el ser y actuar en sociedad. Finalmente, permitir que los presos puedan remitir las penas a través de la educación no es suficiente para una propuesta de integración social, ya que la educación no puede entenderse solo desde esta perspectiva. Por tanto, se desea realmente que estos sujetos puedan reevaluar su rol en la sociedad, entendiendo que el ser y el actuar necesitan respetar el espacio del otro, en el sentido de que su perspectiva debe ser repensada.O sistema penitenciário brasileiro vem sofrendo problemáticas que afetam drasticamente a ressocialização dos apenados. Considerou-se neste estudo os direitos fundamentais no contexto penitenciário, a saber: saúde, alimentação, higiene e, especialmente, a educação. O estudo tem como objetivo contextualizar a educação no cárcere mediante a crise nos presídios brasileiros. Contou com a revisão narrativa, de caráter exploratório e descritivo, de abordagem quanti-qualitativa. Levando em consideração os dados apresentados, é possível perceber que a superlotação vem sendo frequente, sendo o número de presos superior ao de vagas no período de 2017 a 2020. Portanto, há negligência de direitos constitucionais em relação aos encarcerados mediante violação de toda sorte. Reitera-se que os apenados devem cumprir suas penas como preconiza a lei, porém seus direitos fundamentais não podem ser relativizados, submetendo-os a condições desumanas. A inserção dos apenados a uma modalidade de educação é também uma forma de redução do tempo da pena cumprida e, consequentemente, um modo de atenuar a superlotação dos presídios. A educação oportuniza a esses sujeitos a possibilidade de reavaliar as suas ações, exercitando o ser e o agir na sociedade. Por fim, permitir que os presos possam ter remissão das penas pela educação não é suficiente para uma proposta de integração social, pois a educação não pode ser entendida apenas nessa perspectiva.
