Homeschooling: an analysis of the institute, the thesis of general repercussion 822 of the STF and its possible application in the brazilian legal order

Resumo: | Homeschooling is a method of education in which the child or adolescent is supervised by their family members in their homes, providing personalized education based on values that the family believes are most appropriate. The present work will approach the subject analyzing the understanding of General Repercussion of the STF 822 and how it could be introduced in the Brazilian legal system, allowing its application. The difficulties on the subject are that in Brazil there is no law regulating this practice, thus not being allowed such a teaching method in the country. The study of the subject is of great importance since more and more cases of bullying increases, harming several children and leading them to even think about giving up on life, with home schooling being an alternative teaching for these and other diverse cases in which the parents do not condone school education. Among the difficulties pointed out, this work aims to explain the current impasse of regulation and clear doubts from interested families. The methodological procedures used to form this work were done through bibliographic research, with a deductive approach, with a well-defined objective. Therefore, it is concluded that the issue needs regulation in order for it to begin to take effect. Bill 3,179 of 2012 is on the way to being approved and regulating the subject, since the General Theme 822 of the STF embraced the thesis that there is public subjective right conferred by the Constitution on the subject, but its application is not possible due to the lack of regulation. |

El presente trabajo abordará el tema analizando la comprensión de la Repercusión General del STF 822 y cómo podría ser introducido en el ordenamiento jurídico brasileño, posibilitando su aplicación. Las dificultades sobre el tema son que en Brasil no existe una ley que regule esta práctica, por lo que no se permite tal método de enseñanza en el país. El estudio del tema es de gran importancia ya que cada vez aumentan más los casos de bullying, perjudicando a varios niños y llevándolos incluso a pensar en renunciar a la vida, siendo el homeschooling una alternativa de enseñanza para estos y otros casos diversos en los que los padres no apruebe la educación escolar. Entre las dificultades señaladas, este trabajo pretende explicar el actual callejón sin salida de la regulación y despejar las dudas de las familias interesadas. Los procedimientos metodológicos utilizados para conformar este trabajo se realizaron a través de una investigación bibliográfica, con un enfoque deductivo, con un objetivo bien definido. Por lo tanto, se concluye que el tema necesita regulación para que comience a surtir efecto. El Proyecto de Ley 3.179 de 2012 está en vías de ser aprobado y regular la materia, ya que el Tema General 822 del STF acogió la tesis de que existe un derecho subjetivo público conferido por la Constitución sobre la materia, pero su aplicación no es posible por la falta de regulación.O ensino domiciliar é um método de educação que a criança ou adolescente é supervisionado pelos seus familiares em suas casas, fornecendo um ensino personalizado baseado em valores que a família acredita serem mais adequados. O presente trabalho irá abordar o tema analisando o entendimento de Repercussão Geral do STF 822 e como ele poderia ser introduzido no ordenamento jurídico brasileiro, permitindo sua aplicação. As dificuldades acerca do tema é que no Brasil não existe uma lei regulamentando tal prática, não sendo assim permitido tal método de ensino no país. O estudo do tema é de grande importância posto que cada vez mais os casos de bullying aumenta, prejudicando várias crianças e levando elas a pensar até em desistir da vida, sendo o ensino domiciliar uma alternativa de ensino para esses e outros diversos casos em que os pais não compactuam com o ensino escolar. Dentre as dificuldades apontadas, este trabalho tem como objetivo explicar o atual impasse da regulamentação e tirar duvidas das famílias interessadas. Os procedimentos metodológicos utilizados para formar esse trabalho foram feitos através de pesquisa bibliográfica, com abordagem dedutiva, com o objetivo bem definido. Portanto, conclui-se que o tema necessita de regulamentação para que comece a produzir efeitos.
