Resumo: This paper aims at discussing and analyzing the implementation proposals of homeschooling in Brazil in light of what the Brazilian Federal Constitution determines concerning the right of education. This research was carried out from the country current bills and their relations to the previous proposals for law with legal devices, which establish school education as a means of guaranteeing the right of education. Another object of analysis has been the denied provision to the Extraordinary Resource 888815, from the Federal Supreme Court, with effect of general recognized repercussion, which discussed the possibility of considering home education a legal form of providing education to children by their family, based on elementary and secondary school. This study method has a qualitative approach, which focused on documental research, with inspiration on the Content Analysis to categorize, describe and interpret collected data. Current proposals of homeschooling, as well as the previous one, differ from the constitutional edicts to the education in Brazil, besides it smokescreens the State’s duty to provide education to children and adolescents as a public service.

La investigación se basó en los proyectos de ley vigentes en el país y su relación con propuestas anteriores y con las disposiciones legales que prevén la educación escolar como un medio para garantizar el derecho a la educación. Otro objeto de análisis fue el rechazo de la Apelación Especial 888815 de la Corte Suprema Federal, con un efecto de repercusión general reconocido, que argumentó que la posibilidad de que la educación en el hogar se considere una forma legal de proporcionar educación a los niños sobre la base de la educación secundaria y fundamental para la familia. La metodología del estudio es cualitativa y se centra en la investigación documental, inspirada en el análisis de contenido para la categorización, descripción e interpretación de los datos obtenidos. Las propuestas actuales para la educación en el hogar, así como sus precursores, difieren de los dictados constitucionales para la provisión de educación en el país, además de ocultar el deber del Estado de garantizar a los niños y adolescentes el disfrute de la educación como un servicio público.Este artigo propõe-se discutir e analisar as propostas de implantação da educação domiciliar no Brasil à luz do que preconiza a Constituição Federal brasileira acerca do direito à educação. A pesquisa se deu a partir dos projetos de lei que tramitam atualmente no país e suas relações com as propostas anteriores e com os dispositivos legais que preveem a educação escolar como meio de garantia do direito à educação. Também serviu de objeto de análise o negado provimento ao Recurso Extraordinário 888815, do Supremo Tribunal Federal, com efeito de repercussão geral reconhecida, que discutia a possibilidade de o ensino domiciliar ser considerado uma forma lícita de prover da educação aos filhos nas bases do ensino médio e fundamental pela família. A metodologia do estudo tem caráter qualitativo e centrou-se na pesquisa documental, com inspiração na análise do conteúdo para a categorização, descrição e interpretação dos dados obtidos.
