HOME SCHOOLING IN BRAZIL AND THE PROTECTION OF CHILDREN´S RIGHTS

Resumo: | The constitutionality of Act 31798/12 which aims at altering the Law on the Guidelines and Bases of Brazilian Education, or rather, authorizing home schooling in Brazil, is discussed. The main issue of the proposal is whether the project meets the basic rights of children in Brazil. The initial scientific hypothesis underscores that education is a personal basic right, concerned with the child and should be interpreted extensively. The theme has been selected due to its actuality and theoretical relevance for Law. Methodology comprises a theoretical, bibliographical and documental research with a critical approach of the propositions derived from comparative, thematic, theoretical and interpretative analyses. Results confirm the scientific hypothesis, or rather, denying the right of the child not to frequent school is de-legitimating the State from providing and supervising the educational public service. It is tantamount to impair society´s participation in the formation of citizenship and shunning the child from the right to live within diversity, involve itself in society and sociability within the school environment. |

It is tantamount to impair society´s participation in the formation of citizenship and shunning the child from the right to live within diversity, involve itself in society and sociability within the school environment.El objeto de investigación del presente estudio es el análisis de la constitucionalidad del Proyecto de Ley 3179/12, que tiene por objetivo modificar a la Ley de Directrices y Base de la Educación Nacional autorizar el homeschooling en Brasil. La pregunta problema propuesta es debatir si el respectivo proyecto de ley observa los derechos fundamentales de los niños en Brasil. Como hipótesis científica inicial se constata que la educación es un derecho fundamental de naturaleza personalísima, de titularidad del niño y debe ser interpretado extensivamente. La justificativa de la elección del tema proviene de su actualidad y relevancia teórica a la ciencia del Derecho. Con relación la metodología, se utilizó de la investigación teórico-bibliográfica y documental, cuyo abordaje crítico de las proposiciones presentadas fue posible a partir de análisis comparativas, temáticas, teóricas, interpretativas. En la conclusión, se confirmó la hipótesis científica apuntada inicialmente, haya vista que negar el derecho del niño acudir a la escuela es deslegitimar el Estado en la prestación y fiscalización del servicio público de educación; es impedir la participación de la sociedad en la formación de la ciudadanía; es quitar del niño el derecho de convivir con la diversidad, buscar su socialización y sociabilidad en el ámbito escolar.O objeto de investigação da presente pesquisa é a análise da constitucionalidade do projeto de lei 3179/12, que visa alterar a Lei de Diretrizes e Base da Educação Nacional autorizar o homeschooling no Brasil. A pergunta problema proposta é debater se o respectivo projeto de lei observa os direitos fundamentais das crianças no Brasil. Como hipótese científica inicial constata-se que a educação é um direito fundamental de natureza personalíssima, de titularidade da criança e deve ser interpretado extensivamente. A justificativa da escolha do tema decorre de sua atualidade e relevância teórica para a ciência do Direito. Quanto à metodologia, utilizou-se da pesquisa teórico-bibliográfica e documental, cuja abordagem crítica das proposições apresentadas foi possível a partir de análises comparativas, temáticas, teóricas, interpretativas.
