Between polyamory and parallel families: a critical-comparative study about both modalities of family arrangements

Resumo: It develops a descriptive-critical-comparative analysis between two institutes of family law: polyamory and parallel families. The general objective of the research consists on identify the two institutes, differentiating them in terms of their individualizing traits, their main differential characteristics and the legal treatment given to them. For that, the text was developed in respect to the deductive method, an analysis was made (in general) about both species of family arrangement to, after, it has made the individual refinement of them, with the purpose of closing the approach dealing with the criticism to the current state of art in the legal field. The research, which is eminently theoretical, relied on indirect documentary techniques, notably doctrinal and jurisprudential, without prejudice to other sources that were used more punctually. As a result, it is possible to fully conceptualize the two institutes, however, the legal treatment given to them has a similar axis, which is the tendency towards non-recognition - or recognition with reservations - as family entities predicted by the Constitution.

El objetivo general de la investigación es identificar correctamente los dos institutos, diferenciándolos en cuanto a sus rasgos individualizadores, sus principales características diferenciales y el tratamiento jurídico que se les da. Para ello, el desarrollo del texto se dio respecto al método deductivo, habiéndose realizado un análisis general de ambas especies de arreglo familiar para, posteriormente, realizar el refinamiento individual de las mismas, con el fin de cerrar el abordaje que trata sobre la crítica al estado del arte actual en el campo jurídico. La investigación, de carácter eminentemente teórico, se apoyó en técnicas documentales indirectas, en particular doctrinales y jurisprudenciales, sin perjuicio de otras fuentes que se utilizaron de manera más puntual. Como resultado, es posible conceptualizar plenamente a los dos institutos, sin embargo, el tratamiento jurídico que se les da tiene un eje similar, que es la tendencia al no reconocimiento -o al reconocimiento con reservas- como entidades familiares amparadas por la Constitución.Efetua uma análise descritivo-crítico-comparativa entre dois institutos do direito das famílias: o poliamor e as famílias paralelas. O objetivo geral da pesquisa consiste em identificar corretamente os dois institutos, diferenciando-os quanto aos seus traços individualizadores, quanto às suas principais características diferenciais e qual o tratamento jurídico conferido aos mesmos. Para tanto, o desenvolvimento do texto deu-se em respeito ao método dedutivo, tendo-se efetuado análise geral de ambas as espécies de arranjo familiar para, após, efetuar o refino individual dos mesmos, com a finalidade de encerrar a abordagem tratando da crítica ao atual estado da arte quanto à seara jurídica. A pesquisa, que é eminentemente teórica, apoiou-se em técnicas documentais indiretas, notadamente a doutrinária e a jurisprudencial, sem prejuízos de outras fontes que foram utilizadas de modo mais pontual.
