Challenges of sexing in preimplantational genetic diagnosis: limits of autonomy, diversity and identity from a bioethical and legal perspective

Resumo: In this paper, it is proposed to discuss the use of assisted human reproduction, specifically regarding the use of preimplantation genetic diagnosis. Faced to the evolution and the possibility of not only identifying possible diseases in the offspring, but also the sex of the embryo, using the deductive method and the procedures of bibliographic and legislative review, it is reflected on the ethical limits that involve the use of this technique within the Brazilian scope. It is concluded that the regulations regarding the limits of use of the technique are scarce, that there may be legal support to admit the preimplantation genetic diagnosis to prevent serious diseases, however, its use to define the sex of the embryo hurts the freedom of gender identification, which can generate social control.

Ante la evolución y la posibilidad de identificar no sólo posibles enfermedades en la descendencia, sino también el sexo del embrión, utilizando el método deductivo y los procedimientos de revisión bibliográfica y legislativa, se reflexiona sobre los límites éticos que implica el uso de esta técnica en el ámbito brasileño. Se concluye que la normativa en cuanto a los límites de uso de la técnica es escasa, que puede haber sustento legal para admitir el diagnóstico genético preimplantacional para prevenir enfermedades graves, sin embargo, su uso para definir el sexo del embrión lesiona la libertad de identificación de género, lo que puede generar control social.Propõe-se discutir o uso da reprodução humana assistida, especificamente no que se refere ao uso do diagnóstico genético pré-implantacional. Diante da evolução e da possibilidade de não só identificar possíveis doenças nos descendentes, mas também o sexo do embrião, com emprego do método dedutivo e os procedimentos de revisão bibliográfica e legislativa, reflete-se sobre os limites éticos que envolvem o emprego da referida técnica no âmbito brasileiro.
