Affirmative actions and reservation of vacancies for black people in the Public Service: an analysis of the process implemented at the Federal University of Santa Maria

Resumo: This paper discusses the commissions to verify the ethnic-racial condition of public tenders at the Federal University of Santa Maria. The methodological procedures include the analysis of Law 12.990/2014 (20% reservation of vacancies in public tenders for /black women), of Normative Ordinance 04/2018. Data from public tenders for teachers and administrative technicians from 2016 to 2019 are analyzed, with the respective nomination of black men. In theoretical terms, the article is based on the perspectives of Rawls (1997; 2011), Fraser (2001) and Young (2006), on recognition, justice, affirmative and reparatory policies; and Piovesan (2008), Haas and Linhares (2012), Silva and Silva (2014) and Mello and Resende (2019), about the low presence of black women and men in the federal public service. The data indicate that, in the analyzed period, involving public notices for the provision of vacancies to the teaching profession (three in higher education and one in basic education), 4 black professors were appointed and, from the TAE's public notices, 47 high school and higher education professionals . The publication of joint notices and the procedures of the Commission, with contributions in the formulation of the notices, created conditions for the fulfillment of the reserve of 20% of vacancies.

Los procedimientos metodológicos analizan la Ley 12.990/2014 (20% de reserva de vacantes en concursos públicos para mujeres negras), de la Ordenanza Normativa 04/2018, con los datos de las licitaciones públicas de docentes y técnicos administrativos del 2016 al 2019, con la respectiva postulación de hombres negros. En términos teóricos, el artículo se basa en las perspectivas de Rawls (1997; 2011), Fraser (2001) y Young (2006), sobre reconocimiento, justicia, políticas afirmativas y reparatorias; y Piovesan (2008), Haas y Linhares (2012), Silva y Silva (2014) y Mello y Resende (2019), sobre la baja presencia de negros/negras en la función pública federal. Los datos indican que, en el período analizado, involucrando avisos públicos para la provisión de vacantes para la carrera docente (tres en educación superior y uno en educación básica), fueron designados 4 profesores negros y, de los avisos públicos del TAE, 47 de enseñanza media. y profesionales de la educación superior. La publicación de convocatorias conjuntas y los procedimientos de la Comisión, con aportes en la formulación de las convocatorias, crearon condiciones para el cumplimiento de la reserva del 20% de las vacantes.O artigo aborda as comissões de verificação da condição étnico-racial dos concursos públicos na Universidade Federal de Santa Maria. Os procedimentos metodológicos.  E incluem a análise da Lei 12.990/2014 (reserva de vagas de 20% em concursos públicos para /negras e negros), da Portaria Normativa Nº 4, de 2018 (normatiza as Comissões de Heteroidentificação) e a formação da Comissão de Verificação. São analisados dados dos editais de concursos para docentes e técnico-administrativos de 2016 a 2019, com a respectiva nomeação de negros/negras. Em termos teóricos, o artigo se encontra sustentado nas perspectivas de Rawls (1997; 2011), Fraser (2001) e Young (2006), sobre reconhecimento, justiça, políticas afirmativas e reparatórias; e Piovesan (2008), Haas e Linhares (2012), Silva e Silva (2014) e Mello e Resende (2019), acerca da baixa presença de negras e negros no serviço público federal. Os dados indicam que, no período analisado, envolvendo editais para provimento de vagas ao magistério (três no ensino superior e um na educação básica), foram nomeados 4 docentes negros e negras e, dos editais dos TAE’s, 47 profissionais de nível médio e superior.
