ETHICS AND HUMAN RIGHTS IN ASSISTED REPRODUCTION

Resumo: | Assisted Human Reproduction (AHR) summarizes a group of technologies for human procreation. After the birth of the first baby, performed with the AHR, experiments were done and the techniques were never seen in the same way. The aim of this study is to inform about the use of AHR in the bioethics view and to expose the current scenario that surrounds it and it is a bibliographical review. Its methodology consists of searching for materials on the following sites: Latin American and Caribbean Literature on Social and Health Sciences (LILACS); Scientific Electronic Library Online (SCIELO); National Library of Medicine - PUBMED and Legislation; in the English and Portuguese languages, adding 26 files used. Over time, techniques were perfected and various procedures performed. This advance has brought many questions to the subject. Thus, bioethics is born to help scientific medical development based on the dignity of the human being. Research indicates that different positions on embryonic status could be due to the lack of legislation. Thus, countries have established laws, guidelines, resolutions and the like with ethical principles before the AHR. In Brazil, the legislation is still limited and needs further specification to address the issue, even if something has already been done. Lastly, it is not for the medical professional alone to resolve all questions about the AHR, the legality and the Code of Medical Ethics should be adhered to so that advances in medicine do not create problems in the lives of those who use the service or in the private life of the professional responsible for its realization. |

A Reprodução Humana Assistida (RHA) resume um grupo de tecnologias para a procriação humana. Após o nascimento do primeiro bebê, realizado com a RHA, experiências foram feitas e as técnicas jamais foram vistas da mesma forma. O objetivo deste estudo é informar sobre a utilização da RHA na visão da bioética e expor o cenário atual que a circunda e se trata de uma revisão bibliográfica. A sua metodologia consiste na busca de materiais nos sites: Literatura Latino Americano e do Caribe em Ciências Sociais e da Saúde (LILACS); Scientific Electronic Library Online (SCIELO); National Library of Medicine – PUBMED e Legislação; nos idiomas Inglês e português, somando 26 arquivos utilizados. Com o tempo, técnicas foram aperfeiçoadas e várias procedimentos realizados. Tal avanço trouxe para o assunto muitas indagações. Assim, a bioética nasce para auxiliar o desenvolvimento médico científico amparado na dignidade da ser humano. As pesquisas apontam que as diferentes posições sobre o status embrionário poderiam ser decorrentes da falta de legislação. Assim, países estabeleceram leis, diretrizes, resoluções e afins com princípios éticos diante da RHA. No Brasil, a legislação ainda é limitada e carece de mais especificações para tratar do assunto, mesmo que alguma coisa já se tenha feito. Por fim, não cabendo somente ao profissional médico resolver todas as questões sobre a RHA, deve-se ater a legalidade e ao Código de Ética Médica para que avanços na medicina não criem problemas na vida dos que recorrem ao serviço ou na vida particular do profissional responsável pela sua realização.
