Resumo: The present article focuses on questions regarding the control of the fairness of standard contract terms in insurance contracts. It debates which of the clauses should be subject to that control, and concludes that the clauses which shape the insured risk are subject to it. Furthermore, it specifies how the fairness standard should intervene; and, lastly, it questions whether the standard of transparency should play an autonomous role.
