ABERRATIO RELATIONE: operação “Lava Jato” em conluios

Resumo: On June 09, 2019 the news agency The Intercept published a series of reports exposing pieces of what would become one of the biggest national scandals involving the Federal Judiciary and the Federal Prosecution. Members of the Task Force the Operation "Lava Jato", which is how are known the Federal Prosecutors responsible for leading several corruption investigation and corruption charges in Brazil, and the 13th Criminal Court of Curitiba had their dialogues exposed by journalists, revealing possible collusion between them. This paper brings an analisys of the Federal Prosecutors and Federal Judge conducts with the dictates of the Criminal Proceeding Code, focusing on the possible occuring of suspition by the Federal Judge. Therefore, at first was exposed the content of the dialogues and acts practiced by the involved, just as the absense of their denial about the dialogue's veracity, intenting to provide full context to this paper. Moving foward this paper analyzed the conducts with the dictates of the national legislation and jurisprudence, as well as foreign legislation and foreign jurisprudence. Thus, according with the data presented and analyzed, it is concluded that several Constitutional and Infracosntitutional were totally ignored during the Operation "Carwash", specially regarding the counseling and even the possibility of coordination of the accusation activities. Suspition.El 9 de junio de 2019, la agencia de noticias The Intercept publicó una serie de informes que presentaban lo que sería uno de los mayores escándalos nacionales que involucran a la Magistratura Federal y la Fiscalía. Miembros de la Fuerza de Tarea de la Operación "Lava Jato", como se conoció a los Abogados Federales responsables de dirigir las investigaciones y encabezados de varias denuncias de corrupción en Brasil, y el Juez del 13er Tribunal Penal de Curitiba tuvo sus diálogos en una solicitud expuesta por periodistas, revelando posible colusión entre ellos. El presente trabajo analizó la conducta practicada por los Fiscales Federales y el Magistrado con especial atención a los dictados del Código de Procedimiento Penal, enfocándose en la posible sospecha de dicho Magistrado. De esta forma, se expuso por primera vez el contenido de los diálogos y actos practicados por los involucrados, así como la ausencia de veracidad negativa de los diálogos por parte de ellos, con el objetivo de dar un contexto completo al presente trabajo. Se realizó un análisis adicional de la conducta llevada a cabo en relación con la legislación y la jurisprudencia nacional, así como la legislación y la jurisprudencia internacional. Por lo tanto, de acuerdo con los datos presentados y analizados, se concluye que varios dictados constitucionales e infraconstitucionales fueron totalmente ignorados durante la Operación "Lava Jato", especialmente en relación con el asesoramiento e incluso la posible coordinación de las actividades de la fiscalía. Sospecha.Em 09 de junho do ano de 2019 a agência de notícias The Intercept, publicou uma série de reportagens trazendo fatias do que seria um dos maiores escândalos nacionais envolvendo a Magistratura e o Ministério Público Federais. Integrantes da Força Tarefa da Operação “Lava Jato”, como ficaram conhecidos os Procuradores Federais responsáveis por liderar investigações e encabeçamento de diversas denúncias de corrupção do Brasil, e o Juiz da 13ª Vara Criminal de Curitiba tiveram seus diálogos em aplicativo expostos por jornalistas, revelando possível conluio entre eles. O presente trabalho analisou as condutas praticadas pelos Procuradores Federais e do Magistrado com espeque nos ditames do Código de Processo Penal, com enfoque na possível ocorrência da suspeição do dito Magistrado. Desta forma, primeiramente expôs-se o conteúdo dos diálogos e atos praticados pelos envolvidos, bem com a ausência de negativa de veracidade dos diálogos pelos mesmos, com o escopo de dar pleno contexto ao presente trabalho. Adiante se fez a análise das condutas efetuadas frente à legislação e jurisprudência pátria, bem como da legislação e jurisprudência internacionais. Destarte, de acordo com os dados apresentados e analisados, conclui-se que diversos ditames Constitucionais e Infraconstitucionais foram totalmente ignorados no decorrer da Operação “Lava Jato”, especialmente quanto ao aconselhamento e até possível coordenação das atividades da acusação.
