THE MEDIATION APPLIED IN CONFLICTS OF DOMESTIC VIOLENCE AS AN INCLUSIVE PARADIGM OF A CULTURE OF FAMILY NON-VIOLENCE IN BRAZIL

Resumo: Domestic violence against women is an issue that is reflected in the historical context of Brazilian law, and which is also the result of the machismo that has always been shown in social relations. Domestic violence also affects children who are instruments of a central mechanism of family conflicts and are affected by the harmful effects of that same aggression. Domestic violence is the object of this research, which aims to answer the following question: can the practice of penal mediation favor cultural change in society, in the sense of ensuring respect for the constitutional principle of equality between men and women? In order to search for answers to the proposed problem, the work developed as a general objective to understand the basic aspects of mediation in restorative justice as common elements for the inclusion of a legal cultural change of peace and for the specific objectives, to identify the doctrinal and jurisprudential understanding about of penal mediation as a tool for conflict resolution and to situate the condition of women as victims of domestic violence in Brazil. Based on the exploratory, qualitative method with the use of bibliographic sources and references related to the central theme of the work, focusing on the text of journals and scientific articles available on public access platforms. It is possible to verify that the practice of mediation is a viable and humanized solution in the solution of conflicts arising from domestic violence against women.

La violencia doméstica también afecta a los niños que son instrumentos de un mecanismo central de los conflictos familiares y se ven afectados por los efectos nocivos de esa misma agresión. La violencia doméstica es el objeto de esta investigación, que pretende responder a la siguiente pregunta: ¿puede la práctica de la mediación penal favorecer el cambio cultural en la sociedad, en el sentido de garantizar el respeto al principio constitucional de igualdad entre hombres y mujeres? Con el fin de buscar respuestas al problema propuesto, el trabajo se desarrolló como objetivo general comprender los aspectos básicos de la mediación en justicia restaurativa como elementos comunes para la inclusión de un cambio cultural jurídico de paz y para los objetivos específicos, identificar las comprensión doctrinal y jurisprudencial sobre la mediación penal como herramienta para la resolución de conflictos y para situar la condición de las mujeres como víctimas de violencia doméstica en Brasil. Basado en el método exploratorio, cualitativo con el uso de fuentes bibliográficas y referencias relacionadas con el tema central del trabajo, centrándose en el texto de revistas y artículos científicos disponibles en plataformas de acceso público. Es posible comprobar que la práctica de la mediación es una solución viable y humanizada en la solución de conflictos derivados de la violencia doméstica contra las mujeres.A violência doméstica contra as mulheres é questão que tem o reflexo no contexto histórico do direito brasileiro, e que é também fruto do machismo que sempre se mostrou nas relações sociais. A violência doméstica afeta também as crianças que são instrumentos de um mecanismo central de conflitos familiares e são alcançados pelos efeitos danosos dessa mesma agressão. A violência doméstica é o objeto da presente pesquisa, que visa responder ao seguinte questionamento: a prática da mediação penal pode favorecer a mudança cultural na sociedade, no sentido de fazer corresponder o respeito ao princípio constitucional da igualdade entre homens e mulheres? Para busca as respostas à problemática proposta, o trabalho desenvolveu como objetivo geral o de compreender os aspectos basilares da mediação na justiça restaurativa como elementos comuns para inclusão de uma mudança cultural jurídica da paz e para os objetivos específicos, identificar o entendimento doutrinário e jurisprudencial acerca da mediação penal como espeque da solução de conflitos e situar a condição da mulher como vítima de violência doméstica no Brasil. Com base no método exploratório, qualitativo com o uso de fontes bibliográficas e referenciais atinentes ao tema central do trabalho, com enfoque no texto de periódicos e artigos científicos disponíveis em plataformas de acesso público.
