Street screams for human rights: a reflection on the criminalization of feminist and women’s social manifestations in Brazil and their impact on the effectiveness of human rights

Resumo: The objective of this article is to reflect on the growing phenomenon of criminalization of the manifestations of social movements, among them, especially feminists and women, and their consequences for the realization of human rights in Brazil. To achieve this, firstly, a bibliographical review is carried out, based on a feminist epistemology, about the evolutionary and conceptual path of these movements. Afterwards, aspects inherent in the criminalization of social movements and women's resistance, especially regarding the realization of sexual and reproductive rights, are introduced and problematized, entering into the issue of the exacerbated use of criminal law as a symbolic mechanism for solving social conflicts. It is concluded that repression is not the best response to be given by the State to do so, since the right to demonstrate is a right that derives from the right to freedom and is therefore a fundamental right; limitations that are disproportionate to it are misleading and harmful to Human Rights, and do not represent the best technique for the (re) affirmation of democracy in the country. The research is bibliographical; after all, it brings a selection of ideas from authors who are national and international references to enliven the debate on this theme, which is more current each day.

Para alcançá-lo, faz-se, primeiramente, uma revisão bibliográfica, com base em uma epistemologia feminista, acerca da caminhada evolutiva e conceitual desses movimentos. Após, são trazidos e problematizados aspectos inerentes à criminalização das manifestações e protestos dos movimentos sociais e da resistência feminina especialmente no que se refere à efetivação dos direitos sexuais e reprodutivos, adentrando na questão da exacerbada utilização do Direito Penal como mecanismo simbólico de solução dos conflitos sociais. Conclui-se não ser a repressão a melhor resposta a ser dada pelo Estado para tanto, pois o direito à manifestação é um direito que decorre do direito à liberdade e, portanto, é um direito fundamental; limitações desproporcionais a este são equivocadas e atentatórias aos Direitos Humanos, além de não representarem a melhor técnica para a (re)afirmação da democracia no país.
