Audiências públicas eletrônicas: instrumento para a gestão fiscal democrática municipal

Resumo: This dissertation proposes a legal reflection on the theme of popular participation and the New Technologies of Information and Communication. It delimits the issue of e-gov and the effectiveness of public hearings in municipalities under the perspective of the current information society. The 1988 Federal Constitution adopted semi-right democracy, uniting political representation with popular participation. However, in complex, pluralistic and dynamic societies there is great difficulty in the physical presence of citizens and social movements in the institutional spaces open for dialogue between political society and civil society. Thus, in this 21st century, it is necessary to move forward with the adoption of New Technologies to bring together governors and governors, with a view to drawing new and more efficient ways for responsible and democratic fiscal management. Thus, the research problem asks: Can public electronic municipal audiences contribute to broaden popular participation and transparency in the management of public resources? With a focus on the Social Relations and Dimensions of Power Research Line, the research seeks to demonstrate the possibility of participatory budget management through electronic public audiences in municipalities, proving to be a contemporary and swift instrument to encourage participation by digital democracy, in addition to contribute to transparency in the decision-making process. Using the hypothetical-deductive method and the monographic procedure, in a theoretical contextualization based on documentary technique and bibliographical revision, supported by Brazilian legislation and bibliographical sources, it is intended to demonstrate the need to test modern alternatives that adapt the public space to life of citizens. Expand democratic spaces with the use of New Technologies, so that citizens can participate, control and inspect the public thing of the place in which they are. It is not a question of replacing the traditional model of participatory democracy, but rather in ways that complement and stimulate local participation. Therefore, it can be concluded that, at the same time, it is not possible to rule out internet ills, such as social exclusion and digital illiteracy, it is necessary to highlight the proportion that New Information and Communication Technologies have reached in the scenario Brazilian and the feasibility of being extracted, from this virtual space that configures electronic government, innovative perspectives for Brazilian democracy, with awareness and public policies focused on digital education

Delimita-se na questão do governo eletrônico (e-gov) e a efetivação das audiências públicas nos municípios sob a perspectiva da atual sociedade de informação. A Constituição Federal de 1988 adotou a democracia semidireta, unindo a representatividade política com a participação popular. No entanto, em sociedades complexas, plurais e dinâmicas há uma grande dificuldade da presença física dos cidadãos e movimentos sociais nos espaços institucionais abertos para diálogo entre sociedade política e sociedade civil. Assim, neste século XXI é necessário avançar com a adoção de Novas Tecnologias para aproximar governantes e governados, com vistas a traçar novos e mais eficientes caminhos para uma gestão fiscal democrática e responsável. Sendo assim, o problema de pesquisa indaga: As audiências públicas eletrônicas municipais poderão contribuir para ampliar a participação popular e a transparência na gestão dos recursos públicos? Com enfoque na Linha de Pesquisa Relações Sociais e Dimensões do Poder, a pesquisa procura demonstrar a possibilidade da gestão orçamentária participativa por meio das audiências públicas eletrônicas nos municípios, revelando-se um instrumento contemporâneo e célere para incentivar a participação pela democracia digital, além de contribuir para a transparência no processo decisório. Utilizando-se do método hipotético-dedutivo e do procedimento monográfico, numa contextualização teórica fundada em técnica documental e revisão bibliográfica, com suporte na legislação brasileira e fontes bibliográficas, pretende-se demonstrar a necessidade de testar alternativas modernas que adequem o espaço público à vida dos cidadãos. Ampliar os espaços democráticos com o uso das Novas Tecnologias, para que os cidadãos possam participar, controlar e fiscalizar a coisa pública do lugar em que estiverem. Não se fala em uma substituição do modelo tradicional de democracia participativa, mas sim em formas que complementem e estimulem a participação local.
