Resumo: Basic sanitation is essential to ensure everyone’s rigth to health and ecologically balanced environment. However, the universalization of basic sanitation is shown as anobjective to be achieved for the consolidation of a citizenship that still remains unfinished. In this contex, the present dissertation, which is partof the line of reserch Citizenship Modeling theState, has the central objective of analyzing the challenge for the universalization of basic sanitation, inquiring about the contribution of popular participation to its effectiveness.Inthe first part of the research, thedifference between basic sanitation and environmental sanitation wasstudied, as well as the relationship between basic sanitation, health and the ecologically balanced environment. Then, the research was dedicated to ownership for the provisionof basic sanitation services, in view ofthe legal framework of sanitation, Law nº 11.445/2007, changed byLaw nº 14.026/2020.In the second part, federal public policies for the sector and the importance of the planning elaboration by the holders of basic services were addressed. Still,theresources necessary foruniversalization, whether public or private, which leads to the study of ways toprovidethese services. Considering the possibility ofprivate initiativeparticipation in the sector, the commercialization of these services wasapproached, with a positive and negative view of their provision, highlightingthe study of regulation in the sector as a way to avoid further damage. Finally, the emergence of thecouncils of different public policieswas investigated, emphazingthe analysis of municipal councils for basic sanitation, including the result of empirical research carried out with Municipalities of the State of São Paulo of up to 50thousandinhabitants that signed agreements with FUNASA, from 2015to 2018. The method adopted was thehypothetical-deductive, since, based on the hypothesespresented in the central objective, andverificationscarried out throughout the dissertation, it was possible to conclude the need toimprove the legal framework of the sectorand raise the awarenessof governement officials abouttoprioritizethese relevant services, in addition to advancesin relation to the social control bodies of basic sanitation so that, in fact,they can assist in the universalization.

No entanto, a universalização do saneamentobásicomostra-secomo um objetivo a ser alcançado para a consolidação de uma cidadania que ainda resta inconclusa. Nesse contexto, apresente dissertação, que se insere na linha de pesquisa Cidadania Modelando o Estado, tem como objetivo central analisaro desafio para a universalização do saneamento básico, indagando-se a respeito da contribuição da participação popular para a sua efetividade. Na primeira parte da pesquisa, foramestudadasa diferença entre o saneamento básico e o saneamento ambiental, e a relação entre o saneamento básico, a saúde e o meio ambiente ecologicamente equilibrado.Em seguida, a pesquisa dedicou-se à titularidade para a prestação dos serviços de saneamento básico, tendo em vista o marco legal do saneamento, Lei n. 11.445/2007, alterado pela Lei n. 14.026/2020.Na segunda parte, foramabordadas as políticas públicas federais para o setore a importância da elaboraçãodo planejamento por parte dos titulares dos serviços de saneamento básico. Ainda, merecem destaque os recursos necessários para a universalização, sejam eles públicos ou privados, o que levaao estudo das formas para a prestação destes serviços. Considerando apossibilidade da participação da iniciativa privada no setor, abordou-se a mercantilização destes serviços, com a visão positiva e negativa de sua prestação, com destaque ao estudo da regulação no setor como forma de evitarmaiores danos.Por fim, investigou-seo surgimento dos conselhos de diferentes políticas públicas, enfatizando aanálise dos conselhos municipais de saneamento básico, incluindoo resultado de pesquisa empírica realizada com Municípios do Estado de São Paulo de até 50mil habitantes que celebraram convênios com a FUNASA, de 2015a 2018.O método adotado foi ohipotético-dedutivo, pois, a partir das hipótesesapresentadas no objetivo central, e verificações realizadas ao longo da dissertação, foi possível concluir pela necessidade de aprimoramento do arcabouço legaldo setore conscientização dos governantes para a priorizaçãodestes relevantes serviços, alémdo avanço em relação aos órgãos de controle socialde saneamento básicopara que, de fato,eles possam auxiliar nesta universalização.FUNASA - Fundação Nacional de SaúdeOutrosapplication/pdfPEREIRA, Luiz Henrique de Castro.
