Ports and the public interest concession regime: construction, explorations and land-fills

Resumo: | The arrival of the Portuguese Royal Family in Brazil and the opening of its Ports to international trade trigger the need for coast to inland surface connections to promote the import and the export of goods. In 1835 Decree no. 101 grants concession to companies of public interest for construction and exploration of railways. In 1866 the province of Ceará, apparently the first to embrace this modality, adopts similar solution as related to its port. The 1869 plan for the improvement of Brazilian ports (Melhoramento de Portos do Brasil) is defined taking into consideration such regime for concessions. This study intends to identify possible relationships between that regime and the land-fills implemented in port areas. As a main reference, it uses the major plans proposed, from the imperial until the early republican period, to two of the most important ports at the time, the port of Rio de Janeiro and the port of Recife. The relevance of this study goes beyond the possible identification of the relationship between theses concessions and the land-fills associated to port activity. It brings up an array of related questions that deserve further examination. These may point towards rather contemporary concerns. |

Em 1835, o decreto no. 101 permite o regime de concessão a empresas de interesse público para construção e exploração de estradas de ferro. Em 1866, a província do Ceará, aparentemente a precursora em abraçar a modalidade, adota solução semelhante com relação a seu porto. O plano para Melhoramento de Portos do Brasil de 1869 é construído com base na adoção desse tipo de concessão. Esse estudo pretende identificar possibilidades de relações entre o regime de concessões e os aterros realizados em áreas portuárias. Utiliza como principal fonte de referência os principais planos do período imperial até os primeiros anos da república para dois dos mais importantes portos do Brasil à época, os portos do Rio de Janeiro e do Recife. Destarte, a importância desse estudo não se restringe apenas a possibilidade de se verificar a relação entre esse tipo de concessão e os aterros associados às atividades portuárias.
