Resumo: The present study emphasizes a serious problem regarding safety on the roads: the orientation of the brazilian Supreme Court in relation of the “obstacle crimes” and the misdemeanors regarding protection of the users of the roads, creat a serious violation of the principles o  the road traffic in safety conditions, setting at risk all preventive aspects of the Road Traffic Act.
